As a result, we defense attorneys are frequently getting more cases dismissed for a lack of probable cause. It ought not be that way, except citizens are frequently being arrested and charged for crimes they did not commit because, as the Chronicle article claims, the prosecutors assigned to intake lack trial experience and thereby cannot properly evaluate the calls from law enforcement warrant that a charge should be accepted. Houstonians deserve better.

Harris County District Attorney Kim Ogg’s office filed criminal charges in more than 4,500 cases in 2022 that judges said lacked probable cause, the lowest burden of proof needed to detain and prosecute someone.

In El Paso, in 1990, an innocent person could be convicted for a multitude of reasons. This man could have been the first person exonerated by DNA but the evidence that would have set him free was never followed up on by the DA nor the defense attorney. If not for this brave juror who felt intimidated to vote guilty and had the courage to speak out decades later, this man would have died in prison. Unfortunately, after living in prison for decades for a crime he did not commit, he still could not collect the $2 million he should have received.

She was pressured into convicting a man she believed was innocent—and was haunted by remorse. Three decades later, she did something about it.

This place in Utah seems to be good for kids that would otherwise be sent to prison. I hope this approach spreads nationwide. I also defend juveniles in court, and I hate that the juvenile system for many ends up being a pipeline to prison. It costs $25,000 for kids to complete this program and has a high success rate. It would have cost $110,000 a year to send the kid to prison who may then become a hardened criminal.

When a 77 year old lawyer chooses to smuggle drugs into the jail, it speaks either of greed, or more likely desperation as Social Security is not enough for a retiree to live on, and if that is the case it is only going to get worse.

The arrest of a 77-year-old attorney may be the first of many in the case of drugs being smuggled into the Harris County Jail, investigators said.
