Dual Sovereignty Doctrine: The U.S. Supreme Court has consistently upheld the principle that the Double Jeopardy Clause of the Fifth Amendment does not bar successive prosecutions by separate sovereigns. In , Gamble v. United States, 587 U.S. 678 (2019). the Court reaffirmed that “a crime under one sovereign’s laws is not ‘the same offence’ as a crime under the laws of another sovereign” . Gamble v. United States, 587 U.S. 678 (2019). The Court explained that the Double Jeopardy Clause prohibits being tried twice for the “same offence,” but an “offence” is defined by the law of the sovereign prosecuting it. Thus, when two sovereigns prosecute the same conduct under their respective laws, they are prosecuting two distinct offenses . Gamble v. United States, 587 U.S. 678 (2019).
