We lawyers give advice and not all of it makes a client happy because it’s the law and we can’t change the facts….

Here are a few example….

🏠H and W built a multi million dollar real estate business together. H and W did not have children and did not have a WILL.
H’s child from a previous relationship inherits 1/2 of that multimillion dollar real estate business. Texas intestate laws are clear that a child of the deceased who is not the child of the surviving spouse will inherit 100% of H’s portion of the community property. The other 1/2 goes to the surviving spouse who now has a new business partner.

🏡🏡 Widow decides to leave her home to her 2 kids and drafts a WILL to reflect that. When Widow gets sick only one child comes to help. Widow completes and files a Transfer on Death Deed (TODD) naming one child to be the beneficiary. In Texas, the TODD trumps the WILL and the other child will not inherit any portion of the house.
