What’s your disaster contingency?

When preparing wills, trusts, and other estate planning documents, I ask my clients to decide on their “disaster contingency”. Most people have never thought about what they would want to happen to their hard earned estate if none of their spouse or descendants are alive to inherit, either because they have all passed in a common disaster or for other reasons (maybe it’s been 20 years since they wrote their Will and a series of other deaths and/or divorces has happened). It is an unlikely, but not uncommon, situation. Unless you designate your specific wishes for that scenario, state law then determines who inherits your property under the same rules as if you had died without a Will at all, which are complicated and can extend to very distant relatives they may not even know well or at all.

Many of my clients, once they understand this and think about it, would rather leave their legacy (or specifically NOT leave it) to certain relatives and/or charitable or religious organizations they associate with.
