We are a Virginia law office engaged in general practice, but due to our founder's prior work as a prosecutor, we particularly focus on criminal and traffic defense. We currently accept clients from across Central Virginia, including the following cities and counties: Amelia, Brunswick, Caroline, Chesterfield, Colonial Heights, Cumberland, Dinwiddie, Goochland, Hanover, Henrico, Hopewell, Lunenbur

In ex*****on of a certain deed of trust executed by Harrison T. Woody and Sandi Woody, in the original principal amount of $552,420.00 dated September 9, 2020, and recorded in the Office of the Clerk of the Circuit Court of the County of Amelia, Virginia, as Instrument Number 20201571, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the undersigned Substitute Trustee will offer for sale at public auction on the steps of the Amelia County Circuit Court, at 16441 Court Street, Amelia, Virginia, on January 5, 2026 at 2:00 p.m., the property set forth in said deed of trust, described as:

All that certain tract of land in Giles District, Amelia County, Virginia, containing 48.553 acres, more or less, and being more fully described by plat of survey made by Roy E. Easter, Land Surveyors, dated April 7, 2015, which plat of survey is recorded with a deed recorded in the Amelia County Circuit Court Clerk’s Office as Instrument No. 201500516.

TOGETHER WITH a perpetual non-exclusive easement of right of way twenty feet in width for ingress and egress to State Route 1015 as described on the aforesaid plat of survey and further TOGETHER WITH an easement for residential utility lines fifteen feet in width either overhead or buried or both, adjacent to and west of the above easement for ingress and egress as described by the aforesaid plat of survey.

LESS AND EXCEPT that 27.182 acre portion of the above property conveyed to W. David Coleman, et ux and as to which the Noteholders have released any lien, by Instrument No. 202501680, resulting in the aforementioned Deed of Trust now applying only to the 21.371 acre remaining property described as Parcel A in a plat attached to Instrument No. 20201570 and recorded in the Amelia County Circuit Court Clerk’s Office.

Subject to conditions, restrictions, rights-of-way, easements and reservations in the chain of title to this property, and subject to real estate taxes for the years 2025 and 2026.

TERMS: CASH. A bidder's deposit of ten (10%) percent in the form of cash, certified or cashier's check may be required from any bidder, with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to sale. Should the Trustee for any reason whatsoever fail or refuse to convey title to this property, then it is a term of this sale that the Purchaser’s sole remedy is limited to the return of the deposit only, and the sale shall be void and of no effect. Purchaser shall pay all costs of title examination, recording costs (excluding Grantor's tax), and conveyances which shall be by Special Warranty Deed. If the purchaser defaults, Substitute Trustee reserves the right to forfeit the deposit, re-advertise and sell the property at the risk and cost of the defaulting purchaser; or the Substitute Trustee may avail himself of any legal or equitable rights against the defaulting purchaser. Additional terms may be announced at the time of sale. Pursuant to the Federal Fair Debt Collection Practices Act, it is advised that this is an attempt to collect the indebtedness referred to herein, and any information obtained will be used for that purpose.

Public service announcement for all my friends who are small business owners - if you have an LLC, corporation, or other entity registered with the SCC you have to file a beneficial owner report with FINCEN as required by the Corporate Transparency Act unless your entity is exempt (most small businesses and HOAs aren't). Businesses that existed before 1/1/24 have until the end of this year. Businesses started after 1/1/24 have 30 or 90 days from formation depending on when they were formed. Penalties for failing to file or filing late are huge - fines of over $500 per day and possible jail time. There is no fee to file so if on a website that says there is you are in the wrong place. Yesterday, we had the unique experience for a two lawyer firm of having our attorneys appearing more or less simultaneously in two different federal courts in two different states, one in Richmond and the other in Martinsburg, WV.
