The correct nationwide answer is:

CHECK THE CURRENT LAW OF YOUR COMMISSIONING STATE.

Family-notarization rules are not uniform throughout the United States.

📍 FLORIDA EXAMPLE

Florida’s current statute states that a notary may not notarize a signature when the signer is the notary’s:

* Spouse
* Son
* Daughter
* Mother
* Father

Florida also separately prohibits a notary from acting when the notary has a financial interest in—or is a party to—the underlying transaction, subject to the statute’s stated employment exception.

📍 CALIFORNIA EXAMPLE

California’s 2026 Notary Public Handbook says a notary may notarize for relatives unless doing so would provide the notary with a direct financial or beneficial interest.

The handbook specifically advises care when notarizing for a spouse or domestic partner because of California community-property law.

These two examples prove why “I heard notaries can’t notarize for family” is not a complete nationwide rule.

RUN THE CONFLICT CHECK

Before accepting a family appointment, verify:

1️⃣ Is this relationship expressly prohibited?
2️⃣ Am I named individually in the transaction?
3️⃣ Could I receive a direct financial or beneficial interest?
4️⃣ Would my impartiality reasonably be questioned?
5️⃣ Does my employer, contracting company or title agency impose a stricter policy?
6️⃣ What does my state’s current statute, handbook and commissioning agency say?

Even when a relationship is not expressly prohibited, referring the signer to an unrelated notary may reduce doubt, conflict and future challenges.

Do not assume that California’s rule applies in Florida—or that either state’s rule applies where you are commissioned.

Not until you stop, inspect the document and verify your commissioning state’s current rule.

Use this five-step Blank-Space Check:

1️⃣ PAUSE AND REVIEW

Look through the document for empty information fields, missing pages or other signs that it may be incomplete.

2️⃣ DO NOT SUPPLY THE CONTENT

A notary should not choose wording, complete substantive information for the signer or provide unauthorized legal advice.

3️⃣ LET THE SIGNER RESOLVE IT

The signer may need to complete the document or contact its issuer, preparer or an attorney. Do not decide what information belongs in a blank.

4️⃣ CHECK YOUR STATE’S RULE

States do not handle incomplete documents identically. Empty optional fields, unused signature lines and specific statutory exceptions may be treated differently.

5️⃣ PROCEED ONLY WHEN AUTHORIZED

Once the document is ready, complete the required notarial act and certificate according to your state’s law.

📍 CURRENT FLORIDA EXAMPLE:

HOW DO YOU COMPLETE THE VENUE?

The venue identifies the jurisdiction where the notarial act occurs.

It commonly appears as:

State of: __________
County of: __________

📍 TODAY’S IN-PERSON EXAMPLE:

The signer lives in New Jersey.

The property is located in Florida.

The document will be mailed to California.

However, the signer personally appears before the notary in Phoenix, Arizona—which is in Maricopa County.

The venue would be completed:

✅ State of: Arizona
✅ County of: Maricopa

Why?

Because this Arizona example uses the state and county where the notarial act actually occurs—not the signer’s residence, property location or document destination.

⚠️ BEFORE COMPLETING A VENUE:

1️⃣ Confirm your physical location.

2️⃣ Identify the correct county or equivalent jurisdiction.

3️⃣ Read the entire notarial certificate.

4️⃣ If the preprinted venue is incorrect, do not automatically change it. Follow your commissioning state’s correction procedures.

5️⃣ For electronic or remote notarizations, verify your state’s specific location and venue requirements.

6️⃣ Complete every additional certificate element required by your state.

🚫 IMPORTANT:

A notary may complete the notarial certificate.

WHAT SHOULD YOU DO WHEN THE NAME ON THE ID DOES NOT MATCH THE NAME ON THE DOCUMENT?

The correct answer is not automatically:

“REFUSE IT.”

But it is also not automatically:

“IT’S CLOSE ENOUGH.”

STOP. COMPARE. VERIFY.

Name discrepancies may involve:

🔹 A missing middle name or initial
🔹 A maiden or married surname
🔹 A hyphenated name
🔹 A suffix such as Jr., Sr. or III
🔹 A nickname instead of a legal name
🔹 A spelling error
🔹 A shortened first name
🔹 A recently changed name

Your first responsibility is to determine whether you have satisfactory evidence of the identity of the person appearing before you under your commissioning state’s current law.

✅ STEP 1: EXAMINE THE IDENTIFICATION

Confirm that the identification method is acceptable in your state.

Identification requirements differ concerning:

One of the fastest ways to lose money—or create confusion—is to quote a mobile-notary appointment before understanding the assignment.

Before giving a price, ask:

1️⃣ WHERE WILL THE APPOINTMENT TAKE PLACE?

Confirm the complete location and consider:

🔹 Travel distance
🔹 Parking or tolls
🔹 Building access
🔹 Facility requirements
🔹 Appointment time
🔹 Expected waiting time

2️⃣ HOW MANY SIGNERS AND NOTARIAL ACTS ARE INVOLVED?

Do not ask only:

“How many pages are there?”

A long document might contain one notarial act, while a short package might require several.

Ask how many signatures require notarization and how many people will be signing.

3️⃣ WHAT NOTARIAL ACT HAS BEEN REQUESTED?

The signer, document recipient or another authorized party must determine the appropriate notarial act.

If the caller does not know, do not select one for them or provide unauthorized legal advice.

Direct them to the receiving agency, document preparer or an attorney, as appropriate.

4️⃣ DOES EACH SIGNER HAVE ACCEPTABLE IDENTIFICATION?

A customer walks into your office carrying a document that has already been signed.

They say:

“My mother signed this at home. She couldn’t come, but I brought her identification. Can you just stamp it?”

YOUR ANSWER SHOULD NOT BE:

“Sure.”

The person whose signature is being notarized must personally appear before the notary using a method legally authorized by the notary’s commissioning state.

A relative cannot appear for the signer.

Possessing the signer’s identification does not replace personal appearance.

A telephone call does not replace personal appearance.

Recognizing the signer’s signature does not replace personal appearance.

A photograph or prerecorded video does not replace personal appearance.

And a notary should never complete a loose certificate and give it to someone else to attach later.

WHY DOES APPEARANCE MATTER?

The notary must be able to perform the required act, which may include:

✅ Identifying the actual signer
✅ Communicating directly with the signer
✅ Confirming willingness
✅ Observing awareness
✅ Receiving an acknowledgment
✅ Administering an oath or affirmation
✅ Watching the signature when the selected act requires it

Without the signer’s appearance, the notary cannot truthfully certify that the required interaction occurred.

WHAT ABOUT REMOTE ONLINE NOTARIZATION?

Remote appearance may be permitted only when:

🔹 The notary’s commissioning state authorizes it
🔹 The notary holds any required electronic or remote authorization
🔹 The approved audio-video technology is used
🔹 Identity verification requirements are satisfied
🔹 Required records or recordings are created and retained
🔹 The notarial certificate contains any required remote wording

Being a traditional notary does not automatically authorize someone to perform a remote notarization.
