How much does it actually cost to take a divorce case to trial?

The answer goes beyond the number of hours an attorney spends in the courtroom. Trial costs can include attorney time for hearings and trial days, extensive preparation, reviewing the case file and evidence, organizing exhibits, preparing witnesses, developing legal strategy, and time spent by support staff assisting with the case.

Trial preparation can require substantially more time than the actual courtroom proceedings, and the length and complexity of a trial can significantly affect the overall cost.

That does not mean trial is never the right choice. Some disputes cannot be resolved through negotiation, and litigation may be necessary to protect a client's interests. But understanding the financial commitment involved can help you make a more informed decision about whether to continue negotiating, narrow the issues, or proceed to trial.

We discuss the costs and considerations involved in greater detail in our blog, “Understanding the Cost of Going to Trial in a Divorce Case.”

Trial is not the ultimate goal in a divorce case. The goal is to resolve the issues involved in a way that is as civil and workable as possible for both parties. Depending on the circumstances of the case, that may involve negotiation, settlement, mediation, or litigation.

Every case is different, and the appropriate path depends on the specific issues and circumstances involved.

Settlement is not about accepting every proposal that comes your way.

There may be times when an attorney advises a client against accepting a settlement offer and recommends making a counterproposal instead. Ultimately, the client makes the decision about whether to accept, counter, or reject a proposal.

Keeping an open mind to settlement can help create opportunities to resolve a case while still considering your goals and legal interests.

Trial litigation can be expensive, and the cost goes beyond the hours spent in the courtroom.

Trial preparation may include reviewing the case file, preparing exhibits, developing evidence and arguments, and coordinating with legal staff. These costs can add up quickly depending on the length and complexity of the case.

Understanding the potential costs of litigation is an important part of making informed decisions about whether to proceed to trial or explore settlement.

Settlement should not mean settling for less than what is appropriate, but keeping an open mind is an important part of navigating a family law case.

Not every parenting disagreement belongs in court.

When deciding whether to litigate parenting time, the focus should be on the child’s safety and best interests, not personal conflict or resentment.

Swipe through to learn when litigation may be appropriate, and when it may be time to focus on co-parenting instead.

Your divorce is taking forever. Here’s why.

Not every delay is your fault, but some are completely avoidable. A divorce can get dragged out by:
🚩 Ignoring your attorney’s emails
🚩 Taking weeks to send requested documents
🚩 Missing court deadlines
🚩 Failing to respond to filings
🚩 Delaying discovery
🚩 Refusing to make decisions when your attorney needs direction

And those delays can mean more hearings, more attorney time, more stress, and more money.

Not every family law dispute can or should be settled quietly.

When the stakes are high and negotiations aren’t resolving the issues, litigation may be necessary to reach a clear, enforceable outcome.

This can include disputes involving: spousal support, child support & financial contributions, division of assets & marital property, allocation of marital debt, parenting time & parental responsibilities, decision-making for children

When these issues have long-term financial or personal consequences, having a clear legal strategy matters. Litigation isn’t always the first step, but sometimes, it’s the right one.
