The NEW Memo!!

We have been receiving many inquiries regarding the new memo released on May 21 concerning “Adjustment of Status Applications” (green card applications adjudicated within the U.S.), and this has been our response to those inquiries.

"This memo is clearly legally wrong. However, given how the current administration has been implementing and interpreting immigration law, it is unfortunately not surprising. That said, there is a high likelihood that this memo will be challenged in court.

Regardless, at this point, no one really knows exactly how this will be implemented in practice, whether it will actually be implemented consistently, or whether a lawsuit may block/enjoin it altogether. So unfortunately, we cannot provide any specific guidance right now beyond saying that we will have to wait and see how this develops."

Marco is one of the over 500,000 active recipients of Deferred Action for Childhood Arrivals (DACA) - an Obama-era program temporarily shielding some immigrants brought to the US as children from deportation – who are granted a work permit they can renew every two years. He applied for his renewal in December 2025, his lawyer says, and still has not received it.
