The 50/50 timesharing presumption is rebuttable! It is not easy to rebut. It's a high evidentiary burden. You have to prove detriment (read: harm) to the child(ren) by clear and convincing evidence. A lot of cases don't have enough evidence for such a high burden, but many attorneys function as if 50/50 is set in stone rather than treating it like the rebuttable presumption that it is. It's difficult to rebut, but it isn't always as black and white as some attorneys (& judges) choose to see it.
