What happens if you die without a will in Virginia?

The answer is simple: Virginia law makes many of the decisions for you.

When someone dies without a valid will—known as dying intestate—state law helps determine who inherits property and how the estate is administered. For families, the consequences may extend well beyond dividing assets.

A thoughtful estate plan can help you make your wishes clear regarding:

• Who receives your property
• Who administers your estate
• Planning for minor children
• Protecting an unmarried partner
• What happens to business interests
• How assets move through the probate process

Estate planning isn't only about what you own. It's about who and what you want to protect—and making those decisions while you can.

HB Law helps individuals, families, and business owners develop estate plans tailored to their circumstances and goals.

🇺🇸 Serving Our Country. Serving Our Community 🇺🇸

CPT Melissa Huntley-Bosco—the HB in HB Law—has mobilized with more than 1,200 fellow Virginia Army National Guard Soldiers in support of Operation Inherent Resolve (OIR).

Melissa is currently conducting pre-deployment training before heading overseas, with an expected return later in 2027. We are incredibly proud of her continued commitment to service and grateful to every service member and family making sacrifices alongside her.

While Melissa serves our country, HB Law remains right here—ready to serve our community.

Our team remains fully engaged and available, with Nicole Empie, Esq., Rachel Archulet, and Mandi Hodges continuing to support our clients and families throughout the Fredericksburg region.

Estate planning, probate, and business law don’t stop because one member of our team deploys. Melissa helped build HB Law around service, preparation, and taking care of people—and those principles remain at the center of everything we do.

For our clients, colleagues, and community: we’re here, we’re open, and we’re ready to help.

To Melissa and all those serving at home and abroad: thank you for your service. We look forward to welcoming you home.

You have a plan for your business. But do you have a plan for what happens to it without you?

The Fredericksburg region is home to thousands of business owners who have spent years building companies, serving customers, creating jobs, and building value.

But business planning and estate planning don't always happen together.

If you own an LLC, partnership, professional practice, family business, or other privately held company, your ownership interest is part of your estate—and what happens to it after your death or incapacity can affect much more than your family.

Questions worth considering:

• What happens to your LLC interest if you die?
• Does your spouse inherit an interest alongside your business partner?
• Is there a current buy-sell agreement—and does it actually coordinate with your estate plan?
• Who takes control if you are suddenly unable to run the business?
• Is there a succession plan for the next owner or generation?
• Have you considered key-person issues and how the business continues without you?

A will or trust alone may not address everything a business owner needs. Your estate plan, operating documents, ownership structure, beneficiary designations, and succession strategy should work together.

You planned carefully to build the business. Plan just as carefully for what happens next.

Blended Families Deserve Thoughtful Estate Planning

Blended families bring together new relationships, new traditions, and new opportunities—but they can also create unique estate planning considerations.

If you’re in a second marriage or have children from a prior relationship, a simple question is worth asking:

You want to protect your spouse and your children. Does your estate plan actually do both?

Without intentional planning, what you intend to happen may not always be what ultimately happens. Remarriage can affect how property passes, stepchildren may not have the inheritance rights you expect, and beneficiary designations can sometimes override provisions in a will or trust.

A thoughtful estate plan should consider remarriage, stepchildren, beneficiary designations, home ownership, executor and trustee selections, and how you want assets intentionally distributed among the people you love.

Every blended family is different. Your estate plan should reflect your family, your priorities, and your wishes.

At HB Law, PLC, we help Virginia families develop estate plans designed to protect the people and legacy that matter most.

Planning Today for Your Family’s Tomorrow

As parents, we spend a lot of time planning for our children’s future—education, opportunities, milestones, and everything in between. Estate planning is another important part of that preparation.

A thoughtful estate plan allows parents to make important decisions ahead of time rather than leaving those decisions to others.

It can help you:

• Name the people you would want to serve as guardians for your children
• Decide who should manage assets and inheritance for them
• Establish how and when your children receive their inheritance
• Put trusted people in place to make financial and healthcare decisions
• Give your family clear guidance when they may need it most

Estate planning isn’t simply about transferring property. It’s about creating a plan for the people you care about and making your wishes clear.

At HB Law, PLC, we work with Virginia families to create practical estate plans tailored to their circumstances, priorities, and goals.

Protect today. Give your family peace of mind tomorrow.

⚖️ AI Can Draft a Will. But Can It Protect Your Family? ⚖️

Artificial intelligence has made it easier than ever to generate documents, find information, and answer basic questions. But when it comes to estate planning, convenience should not be confused with legal protection.

A will or trust isn’t simply a document—it’s part of a legal plan designed around your family, your assets, your goals, and Virginia law.

Using AI alone to create estate planning documents can carry risks:

💭 AI doesn’t know your full circumstances. A seemingly small detail about how property is titled, a prior marriage, minor children, a business interest, or a beneficiary with special circumstances can dramatically change the appropriate plan.

💭 The document may not comply with Virginia law. Ex*****on requirements, signatures, witnesses, powers granted to fiduciaries, and other provisions matter. A document that looks professional may still create problems when it is actually needed.

💭 AI may confidently provide incorrect or outdated information. Estate planning involves state-specific statutes, tax considerations, and legal consequences that cannot always be reduced to a generic template.

💭 You may not know what you’re missing. One of the most important roles of an estate planning attorney is asking the questions you didn’t know needed to be asked.

The true test of an estate plan usually comes when you are no longer able to explain what you intended. That is a difficult time for your family to discover that a document doesn’t accomplish what you thought it did.

We believe AI should not be relied upon for legal matters or used as a substitute for qualified legal counsel. There is also an important privacy and confidentiality concern. Your legal matters are personal. Your family’s information is personal. Think carefully before putting either into an AI platform.

HB Law, PLC, as an experienced estate planning attorney, does more than prepare documents. We help you understand your options, identify potential problems, and develop a plan tailored to your family, assets, and future.

AI can generate words. An experienced attorney helps make sure those words actually protect the people who matter to you.
