The ARC(Attorneys representing children) is another program that I am honored to be able to assist the Court with. This is a program just recently initiated by the Bristol County Courts but has been being used by the Barnstable County Courts for awhile with success. This program is one where attorneys from the county agree to give of their time to assist the Court baby representing a minor child or children in a pending divorce, custody and/or visitation matter that is extremely contested and there has been a battle in the case and the Court feels that the child's desires need be heard and addressed and bought before the court. Chief Justice Anthony Nesi stated at tonight's award presentation that the Judges have begun assigning cases to the Attorneys involved in this program.

The Lawyer for the Day program is an awesome program for those who can't hire an attorney and have no choice but to represent themselves. The Lawyer for the Day is at the court house and will assist you in preparing paperwork to file on your matter, explain the procedures and how the court works in their situation and how to address the court relative to their specific situation. The Lawyer for the Day does not represent the individual or appear before the judge on behalf of the individual. The program is made up of local attorneys who donate their time the Court to assist these individuals. I am proud to be a part of this program and to be able to assist the Court in providing some assistance to those individuals who would not otherwise be able to have the assistance of an attorney.

Did you know that if a judge orders a party to do something then that party is in contempt and you can seek to have your attorney's fees paid for representing you on the contempt!

There are two types of Custody in the Family Court, legal and physical. Legal custody is a parent's right to access medical and educational information about the minor child and to assist in making major decisions. Physical custody is where the child resides. The standard custody arrangement in Family Court is joint legal custody and physical custody is usually to the Mother.

I have been thinking about all the people who work but can't afford the large retainer required to hire an attorney for a family court matter. I am thinking of holding a class that individuals can pay to come for a couple of hours to learn the basics of dealing with a matter in the family court system. What are your thoughts?
