Do prescription medications matter in a custody case?

Sometimes yes. Sometimes no.

If you’re taking medication exactly as prescribed and it doesn’t affect your ability to parent, it may not be a major issue.

But if the medication can be abused, impacts mental health, or raises concerns about your ability to safely parent, the court may look much closer.

Be prepared to explain:
whether it’s prescribed,
whether you take it correctly,
and whether it affects your parenting.

How nice does your house have to be to win a custody case?

Probably not nearly as nice as people think.

The court is usually not looking for a mansion or a perfect home. What judges are really looking for is whether the child has:
• a safe environment
• stability
• appropriate sleeping arrangements
• and a home that meets the child’s basic needs

You do not have to “outspend” your ex to be a good parent.

But housing conditions absolutely can become an issue if the court believes the environment is unsafe, unstable, or inappropriate for the child.

Can your spouse lock you out of the marital home during a divorce?

In most cases, NO.

One of the biggest misconceptions people have is thinking that if their name isn’t on the deed or lease, they have no rights to the home. That’s usually not true if it’s the marital residence.

Your spouse generally cannot:
❌ Change the locks
❌ Throw your belongings out
❌ Kick you out overnight

Just because the relationship is ending.

Now, there ARE exceptions:
• Domestic violence or safety concerns
• Orders of protection
• Situations where you voluntarily moved out and established another residence

But if you come home from work and suddenly can’t get into your own house, that’s a serious issue.

If that happens:
✔️ Contact an attorney
✔️ Contact law enforcement if necessary
✔️ Do NOT escalate the situation

Your ex not following the parenting plan?

That’s not just frustrating — it can seriously impact your case.

A parenting plan is a COURT ORDER, not a suggestion. But one of the biggest mistakes people make is responding by violating the order themselves.

Don’t:
❌ Withhold the child
❌ Skip exchanges
❌ Try to “get even”

Two wrongs don’t make a right, and judges notice that.

What SHOULD you do?
✔️ Document everything
✔️ Save texts, screenshots, and missed exchanges
✔️ Keep detailed records
✔️ Stay calm and follow the order yourself

Once there’s a pattern, an attorney can help you take the matter back to court. In many cases, the violating parent can be held in contempt.
