If you’re injured, seek medical attention. It doesn’t matter whether you have health insurance, because you’re going to go through your auto insurance for any accident-related medical treatment. Through PIP / No-Fault, your auto insurance covers 80% of the first $10k of your medical treatment if certain qualifications are met, even if another party is at fault.

Assuming you’re in a safe location and physically able to do so, document the accident scene to the best of your ability. Often you’ll have to move the vehicles from the precise scene of the accident to allow traffic to continue or commence, and doing so could compromise the apparent liabilities of the parties involved. You can’t always — and should never — count on the other party/parties to be honest with the responding officer. Protect yourself and take pictures, videos, the environment, intersection or traffic control devices and anything else which may be pertinent in determining both liability and the extent of the vehicles’ damage. Only do this when it is safe.

Yes, you can. Although you should be aware that the first attorney/firm is entitled to compensation for the work they’ve done up until the point you discharge their services. The prior attorney will likely contact your new attorney and place a “charging lien” on your case; the new attorney will then have to pay the prior attorney for their services, usually through their own fee, before they can disburse settlement funds to you.

Insurance companies are going to do their own independent investigation into the cause(s) of an accident, and determining fault. On average a police report in Florida takes 5-7 business days before it’s available and often the insurance companies wait for that police report before determining liability. Which means if you’re waiting for the other person’s insurance to pay for your vehicle’s repair, it could take a couple weeks before your car is even assessed. To save time, if you have Collision Coverage on your policy, you can go through the repair/replacement process through your own policy, and once the at-fault party’s insurance accepts liability, your vehicle may already be done — at the very least the repair/replacement process should be underway. Through a process called “subrogation,” your insurance will seek reimbursement for your vehicle’s repair from the at-fault party’s insurance after they accept liability.

Generally — the at-fault party, but like most things, there are always exceptions. Florida requires all drivers to carry Property Damage Coverage insurance, which would cover your car should someone else cause the accident. But that coverage may be as little as $10,000. If the damage to your vehicle is more than $10,000, you may be in a bind if you don’t have Collision Coverage on your policy. What if the person that caused the accident doesn’t have insurance at all? Again, you better have Collision Coverage on your policy to pay for the damage to your vehicle.

Florida is one of the few states where you are NOT required to carry Bodily Injury/liability (BI) coverage. What that means is that someone can injure you in an accident, have “legal” insurance, but without BI coverage, you are unable able to recover anything from their policy. With UM coverage on your auto policy, you can recover from your own insurance as if the other driver had BI coverage. Our office has to turn down cases weekly where prospective clients don’t have UM coverage and the at-fault party didn’t have BI coverage. It’s a sad and frustrating situation which can be avoided.

Ideally, you’d want great insurance coverage with a great insurance company. But for most people that’s not reality and people are often left choosing one or the other. If you’re in that situation, get the best coverage you can afford — even if its with one of the lower-ranked companies. Your insurance policy is a contract, a lengthy one at that, riddled with exceptions and nuances by which your insurance company can deny a claim or even void coverage. They will not do you any favors. If an insurance doesn’t have to pay on a claim — they won’t. Even the good ones. So, get good coverage with an average or lower-tier company, over basic coverage with one of the boutique companies. I can't stress enough that if you’re driving in Florida — especially South Florida — you are NOT covered unless you have Uninsured/Underinsured Motorist Coverage (UM).

My opinion: Get Bodily Injury (BI) coverage, get UM coverage, get collision coverage, get comprehensive coverage all with the highest limits you can afford. Then, you are TRULY covered. Having an auto policy with a Chubb, Hartford or Amica (some of the top-tier insurance companies) without UM won’t do you any good if you’re in a situation where the at-fault party doesn’t have adequate coverage. Get the best insurance coverage you can afford.

That’s right, not only did the statute of limitations (SOL) for actions founded in negligence change recently (Florida Tort Reform), it changed DRASTICALLY in March of 2023 (House Bill 837) from FOUR years to TWO years — cutting it in half. Any potential cases that occurred after the Bill passed are subject to the two year SOL, where actions occurring prior are subject to the four year SOL.

Look at the commercials targeting consumers and you’ll agree. “Only pay for what you need,” we’ve all seen that one, right? You don’t “need” coverage until after a claim arises and guess what — then it’s too late. The companies are pushing minimal coverage policies to limit their exposure in the event a claim arises. Make sure you have the right coverage BEFORE you need it.

As we enter the holiday season, the traffic in South Florida is becoming increasingly chaotic, and of course that means more accidents. We cannot emphasize enough the importance of making sure your insurance premiums have been paid and that you're properly covered. If you've been told by your insurance agent that you have "full coverage," I implore you to actually look at your coverage. Make sure you have UM (Uninsured/Underinsured Motorist) coverage on your policy. That's truly the only way you'll be covered should something happen.
