Credible Identifying Witness

When a signer has no valid ID

✔️ What is it?
A credible identifying witness is a person who:
- Personally knows the signer
- Can confirm their identity
- Appears in person
- Takes an oath before the Notary
- Swears the signer is who they claim to be

They act like a human ID when the signer has no acceptable identification.

📘 Texas Rules
Texas allows:

🔹 1 credible witness personally known to the Notary for acknowledgments
(Civil Practice & Remedies Code §121.005)

🔹 A credible witness personally known to the Notary or who presents valid ID for other notarial acts
(1 TAC 87.40(2))

🛑 Important
The witness must be willing to take an oath and accept legal responsibility.

Power of Attorney and medical directive signings don’t have to be complicated. When the paperwork is clear and the signer is ready, it’s a smooth process.

Here’s my go-to checklist:
✅ Verify the signer’s ID
✅ Witness the signature
✅ Complete the notarial section (venue, commission info, seal)
💰 Payment options: Zelle, CashApp, wire transfer, or cash—whatever works best for the client.

I always remind myself:
“Don’t just notarize—empower.”
