Just because someone owns a trademark doesn’t mean you can’t have it.

There are legal strategies most attorneys won’t tell you about — not because they’re risky, but because they require actual creativity and work.

In this video I’m breaking down how I’ve helped founders obtain trademarks that were already registered by a third party.

If you’re building something serious and the name you want is “taken” — this is worth watching before you give up or rebrand.

A client came to me wanting a trademark that was already owned by someone else.

Most attorneys would have stopped there.

We didn’t.

There are real, legal paths to obtaining a trademark even when a third party holds it — coexistence agreements, negotiated assignments, cancellation proceedings, and more.

The difference between a founder who gets the brand they built and one who has to start over? Usually just knowing what options actually exist.

In Kennedy Center v. Chuck Redd, the Kennedy Center reportedly sued jazz musician Chuck Redd for $1 million after he backed out of a 2025 holiday performance. But the court dismissed the breach-of-contract claim because the agreement was never signed.

The business lesson is bigger than entertainment.

Whether you are relying on a performer, vendor, contractor, supplier, manufacturer, or parts provider, your business should not be dependent on an unsigned promise.

Fast growth can make a business look stronger than it actually is.

Revenue is up.

Clients are coming in.

The brand is getting attention.

Opportunities are opening.

But behind the scenes, the legal foundation may still be built for the version of the business that existed two years ago.

Old contracts.

Unclear ownership.

Informal vendor terms.

Unprotected business assets.

Handshake deals that no longer match the size of the opportunity.

Growth does not eliminate risk. It exposes it.

At Berger Law Firm, we help business owners align their legal structure with the level of business they are actually operating.

Because a serious business should not be relying on starter paperwork.

Patagonia recently sued drag performer and climate activist Pattie Gonia in federal court, claiming the name and related merchandise are too close to Patagonia’s brand.

Patagonia alleges trademark infringement, dilution, and breach of a prior 2022 agreement after Pattie Gonia allegedly expanded from a stage name into merchandise, events, and trademark filings.

Pattie Gonia says the name is parody/commentary and not an attempt to impersonate Patagonia.

Handshakes are for introductions. Contracts are for serious businesses.

If you sell services, your agreement should protect your money, your time, your scope, and your reputation.

High-level entrepreneurs don’t wait until there’s a dispute to get protected.

Trademark disputes are rarely just about trademarks.

They’re about leverage.
Negotiation power.
Market position.
Business risk.

A TTAB cancellation filing does not automatically mean you lose your brand.

But how you respond next matters.

We help founders and established businesses navigate high-stakes trademark disputes strategically — not emotionally.
