Not every SAP is allowed to evaluate you. Here is what that means for your career.

If you are a safety-sensitive employee facing a DOT drug or alcohol violation, here is something most people never learn until it causes a problem.

A Substance Abuse Professional can only evaluate you within the state or geographic area their license or credential covers. Under 49 CFR Part 40, a SAP is not allowed to step across state lines and conduct your evaluation unless they are properly licensed or credentialed to practice there.

Why does this matter to you? Because if your evaluation is done by a SAP operating outside their authorized jurisdiction, that creates problems. The good news under the rules is that you, the employee, are protected and will not be forced to start over with a second SAP. But you still deserve to work with a SAP who is doing everything correctly from the very first step.

So before your evaluation, you have every right to ask one simple question: are you authorized to conduct my SAP evaluation in this state? Go even further to ask: "are you authorized to conduct MY SAP evaluation in the state that I (employee) reside?"

POSTPONED: Expanding Identity Verification- -1 June 2026

FMCSA has postponed the rollout of identity verification to existing users. Identity verification is still required for new registrations of C/TPAs, MROs, SAPs, and employers not linked to a Portal account.

The FMCSA reports they will follow up with additional information when identity verification for existing users is reinstated.

FMCSA Clearinghouse: Identity Verification Now Required for Existing Accounts

Action needed by 6 July 2026.

In April 2026, FMCSA launched identity verification for new Clearinghouse accounts. The Agency is now expanding that requirement to existing users. All registered C/TPAs, MROs, SAPs, and employers not linked to a Portal account must complete identity verification.

If you do not complete this step by 6 July 2026, you will lose access to the Clearinghouse until verification is successfully completed.

Do not wait until the deadline. Log in, complete your identity verification, and protect your continued access.

After a DOT drug or alcohol violation, your employer owes you something. And it is FREE.

If you hold a safety-sensitive position and you just had a DOT violation, here is a right that many employees never know they have.

Under 49 CFR Part 40, Section 40.287, your employer is REQUIRED to give you a list of qualified Substance Abuse Professionals. That list must include names, addresses, and telephone numbers of SAPs who are readily available to you.

And here is the part that matters most: your employer cannot charge you a single penny for that list. Not for compiling it. Not for providing it.

This applies to every safety-sensitive employee across all six DOT operating administrations. It even applies if you are an applicant or a brand new employee.
So if you are facing a violation and you have not been given a SAP list, you have the right to ask for one. Knowing your rights is the first step toward getting back to work the right way.
