WCNC recently asked me the question: In this heat, what can you legally do if you see a child or elderly person in a vehicle, or an animal, with the windows rolled up on the heat, in obvious distress? Life is always more important than property, and that premise should be kept in mind. Here's the answer:

If you live in the Indian Land (NC) and Lancaster (SC) areas of Charlotte, you have no doubt been affected by pollution from the nearby New Indy paper mill. A class action lawsuit was filed against the plant to try and help the impacted families in the area. After years of this litigation, we're pleased to announce a $103 million settlement with the plant. I'm very thankful to Kenny and Candice White, lifelong friends of mine, for bravely stepping forward to serve among the lead plaintiffs in this (putative) class action. Nothing is ever easy, and this wasn't either. Hopefully, the efforts of the New Indy plaintiffs will make this part of our world a better place.

The settlement includes an estimated 6,000 individuals.

Police pursuits over the last several days have resulted in two separate tragedies in Person and Wake County (Raleigh). I was interviewed last night by ABC 11 about changing the gross negligence standard in North Carolina, which is really no standard at all when it comes to public safety (to the innocent by-standing public). Other states, such as Georgia, have changed their law to meet the challenge and so should we.

While bystanders injured in such chases can pursue civil damages, they face challenging circumstances in North Carolina.

This morning the Charlotte-Mecklenburg Fraternal Order of Police, Lodge #9 issued this press release in response to WCNC's reporting on the police pursuit issue. I'll let you reach your own conclusions about its tone and content.

But we were disappointed to see the FOP describe WCNC's important story as "sensationalizing the tragedy." Until WCNC applied this scrutiny, there had been virtually no transparency from CMPD. No body cam or cruiser video has been released. The police officers involved have been suspended, but CMPD will provide no detail. CMPD won't even confirm why.

Most of us, in our jobs, and in our private life, are responsible for the harm that we cause to others. No person, particularly those in positions of power or public trust, should be more or less totally beyond responsibility for the harm that they cause.
