I am a VA-accredited attorney. Typically, I represent clients after the VA has issued an initial decision on a veteran’s claim, either because the VA has denied the claim or there is a problem with the VA rating. I may be helpful to you in further developing the evidence in support of your claim and crafting persuasive and legal arguments on your behalf to submit to VA. In addition, I can assist you in navigating the VA appeals process.

I am also licensed to practice law by the California State Bar, the Nevada State Bar, the Oregon State Bar and the District of Columbia Bar.

The U.S. Court of Appeals for Veterans Claims has "exclusive jurisdiction to review decisions of the Board of Veterans' Appeals ... [with the] power to affirm, modify, or reverse a decision of the Board [of Veterans' Appeals] or to remand the matter, as appropriate." 38 U.S.C. § 7252.

I am admitted to practice law before this Court and have represented two different mesothelioma victims successfully before that Court. In both cases the VA denied benefits to the veteran, we filed Petitions for Writs of mandamus and in both cases, on the eve of the Court decisions, the VA relented, rated both veterans 100% disabled and paid them back pay benefits, dating from the day of their initial application for service connected disability benefits.

I can assist you if you are a veteran with mesothelioma and have been denied VA benefits.

The wartime veterans of our military and their surviving spouses may be eligible for a pension benefit that can help pay for in-home care and assisted living. Many attorneys, even those who are familiar with the Veterans Affairs (VA) rules and procedures, are unfamiliar with the pension benefit and its additional allowances, known as Housebound and Aid and Attendance. This additional tax-free cash payment can be a lifesaver for a veteran who is faced with a health diagnosis that would otherwise require that they drain the family’s resources to receive the care that they need.

I can assist you if you are a wartime veteran and wish to apply for these benefits. I am attending this Continuing Legal Education Seminar on December 15, 2022, and I will post afterward with more information about these benefits.

Presenter: Jim Wolverton, JD

WHAT WE’LL COVER

The wartime veterans of our military and their surviving spouses may be eligible for a pension benefit that can help pay for in-home care and assisted living. Many attorneys, even those who are familiar with the Veterans Affairs (VA) rules and procedures, are unfamiliar with the pension benefit and its additional allowances, known as Housebound and Aid and Attendance. This additional tax-free cash payment can be a lifesaver for a veteran who is faced with a health diagnosis that would otherwise require that they drain the family’s estate plan to receive the care that they need.

During this webinar, Jim Wolverton will cover the VA rules for pension qualification, discuss planning opportunities and contrast this benefit with Medicaid. He will also cover the basic structure of the ElderCounsel Veterans Asset Protection Trust®, an irrevocable trust specifically designed for VA pension planning. This webinar will open your eyes to benefits our veterans have earned but very few are accessing.

Learning Objectives:

Understand the basic service, financial, and medical qualification rules for VA pension benefits;
Understand VA pension planning strategies;
Understand the structure of the EC Veterans Asset Protection Trust®; and
Contrast the VA pension benefits with Medicaid benefits.

Filing a claim for VA benefits is not the only option for veterans with mesothelioma and other asbestos-related diseases, but every bit of compensation helps, and with your military service, you have earned these VA benefits.

Free legal help with obtaining V.A. Benefits:

I am specially licensed by the United States Department of Veterans Affairs (LIc. 28156). By law I cannot charge you for my services in helping you obtain service-connected VA disability benefits.

If you are a U.S. military veteran - wartime or not - and you were exposed to asbestos during your service, you are very likely eligible for service-connected V.A. disability benefits if you suffer from asbestos related disease.

Let me help guide you through the process.
