🚨 Who Has Jurisdiction Over Your I-485?
Generally, USCIS has jurisdiction over your Adjustment of Status (I-485) if you are not in removal proceedings and do not have a final order of removal.
But there’s an important exception: “arriving aliens.” Even while in removal proceedings, USCIS may retain jurisdiction over an arriving alien’s I-485.

Trump’s Immigration Courts Won’t Wait for Your I-130 — But This New Loophole Could Change Everything
Immigration Court has changed dramatically. With cases moving faster, waiting for a pending I-130 to be approved before proceeding in court may no longer be a realistic strategy.

A standalone I-130 can take 22+ months, while many individual hearings may occur much sooner.

One strategy we are researching is the concurrent filing of the I-130 and I-485 with USCIS—even when USCIS may not have jurisdiction over the I-485.

So why potentially file the I-485 anyway?

Because concurrent filings may be reaching USCIS interviews much sooner, potentially allowing USCIS to adjudicate the I-130 quickly. The I-485 could then be addressed based on the proper jurisdictional procedure.

⚠️ But this is NOT a strategy we are recommending yet. We are doing additional research to determine whether this approach is legally sound, procedurally appropriate, and ethically permissible before implementing it in our cases.

This is an evolving area of immigration law. Don't assume this strategy applies to your case without a thorough analysis of your removal proceedings and adjustment eligibility.
