In West Virginia Rivers Coalition v. Chemours, the Fourth Circuit clarified what showing is required by the movant to establish irreparable harm for purposes of a preliminary injunction.

In vacating the injunction, the panel held harm to the public may not be considered as part of the irreparable harm determination; rather, the movant must show it is more likely than not that the movant itself will suffer irreparable harm to obtain a preliminary injunction. The decision provides guidance regarding the irreparable harm showing and the evidence a movant must produce to demonstrate the harm they will suffer without judicial intervention. Pennsylvania’s Supreme Court has ruled that municipal stormwater “fees” are actually taxes — a landmark decision with major implications for stormwater programs across the Commonwealth. In Borough of West Chester v. Pa. State System of Higher Education and West Chester University, the Court held that stormwater charges primarily benefit the public at large and are imposed without property owner consent, making them taxes rather than user fees. The ruling could significantly impact the viability of stormwater charges currently used by more than 70 municipalities and authorities in Pennsylvania. A significant April 2026 decision from the Eleventh Circuit provides important clarity on threshold issues under the APA and NEPA.

In Friends of the Everglades v. Secretary of Homeland Security, the court vacated a preliminary injunction that had halted construction of an immigration detention facility in the Florida Everglades. The court concluded that the plaintiffs failed to identify a final agency action under the APA and that the project did not qualify as a “major federal action” under NEPA.

The ruling serves as a strong reminder that early-stage jurisdictional and statutory framing can be dispositive in complex environmental and administrative law disputes.
