⚠️ ¿Nuevos requisitos para solicitar el pasaporte estadounidense de un menor?

El Departamento de Estado de Estados Unidos está considerando exigir que los padres o tutores que soliciten un pasaporte para un menor presenten pruebas de su propia ciudadanía o estatus migratorio.

Entre los documentos que podrían solicitarse estarían:

• Pasaporte o certificado de nacimiento estadounidense
• Tarjeta de residencia permanente
• Formulario I-94
• Otros documentos que acrediten el estatus migratorio de los padres

Actualmente, cuando un niño nace en Estados Unidos, los padres generalmente deben demostrar el parentesco y presentar identificación, pero no necesariamente documentación adicional sobre su propio estatus migratorio.

Es importante aclarar que esto es solamente una propuesta en borrador y todavía no constituye un requisito vigente. Su implementación podría enfrentar importantes desafíos legales relacionados con la ciudadanía por nacimiento protegida por la Decimocuarta Enmienda.

The U.S. State Department has proposed requiring parents applying for passports for their ​children to provide proof of their own citizenship or immigration status as part of President Donald Trump's latest effort to limit birthright ‌citizenship.

USCIS confirmó que, desde el 31 de agosto de 2026, solo acepta la edición 08/24/26 del Formulario I-864. También advierte que un congelamiento de crédito puede impedir la verificación necesaria. Fuente oficial de USCIS⁠.

🚨 IMPORTANTE ACTUALIZACIÓN MIGRATORIA: NUEVO FORMULARIO I-864

USCIS publicó una nueva edición del Formulario I-864, Affidavit of Support.

A partir del 31 de agosto de 2026:

✅ Solamente se acepta la edición 08/24/26.
❌ Las versiones anteriores ya no serán aceptadas.

Además, USCIS advierte que, si el patrocinador o joint sponsor tiene un congelamiento de crédito o alguna medida de seguridad que impida el acceso a su reporte, deberá eliminar temporalmente esa restricción antes de presentar el formulario. De lo contrario, USCIS podría no obtener la información necesaria para evaluar el patrocinio económico.

Antes de enviar un caso, es importante:

• Confirmar que se está utilizando la edición correcta del formulario.
• Verificar que el patrocinador no tenga bloqueado su reporte de crédito.
• Revisar cuidadosamente los ingresos, impuestos, tamaño del hogar y documentos financieros.

Un formulario desactualizado o una verificación financiera incompleta puede causar el rechazo del paquete o retrasos importantes en el proceso migratorio.

🏠 Tu solicitud de ciudadanía podría ir más allá del formulario N-400 y llegar hasta tus vecinos, empleadores o compañeros de trabajo.

USCIS incorporó formalmente las llamadas “investigaciones vecinales” a sus políticas de naturalización. Antes de la ceremonia de juramentación, un oficial puede investigar el domicilio, empleo, carácter moral y apego del solicitante a los principios de Estados Unidos.

¿Significa esto que USCIS tocará la puerta de todos tus vecinos? No. Estas investigaciones son discrecionales y se determinan caso por caso. Pero sí significa que la consistencia y el carácter importan ahora más que nunca.

Los solicitantes pueden presentar voluntariamente cartas de referencia de personas que realmente los conozcan, preferiblemente ciudadanos estadounidenses, como:

🏡 Vecinos
💼 Empleadores o compañeros de trabajo
🤝 Líderes comunitarios o religiosos

Una buena carta no debe limitarse a decir: “Es una buena persona”. Debe explicar cómo conocen al solicitante e incluir ejemplos reales de su honestidad, responsabilidad, participación en la comunidad y buen carácter moral.

Sin embargo, estas cartas no son automáticamente necesarias ni convenientes en todos los casos. Cada N-400 debe evaluarse individualmente, especialmente si existen arrestos anteriores, problemas fiscales, viajes prolongados, antecedentes matrimoniales complejos, inconsistencias o dudas sobre cómo se obtuvo la residencia permanente.

La ciudadanía nunca ha sido “un formulario más”. Al solicitarla, USCIS puede volver a revisar todo tu historial migratorio antes de aprobarte.

🚨 Major Changes Coming for F-1 & J-1 Students – Effective September 15, 2026

The Department of Homeland Security has issued a final rule that significantly changes how international students maintain status in the United States.

Key changes include:
✅ The end of “Duration of Status (D/S).” Students will now receive a fixed expiration date on their I-94.
✅ Many students who need additional time will have to file Form I-539 with USCIS, pay filing fees, and wait for approval.
✅ The F-1 grace period after completing studies is reduced from 60 days to 30 days.
✅ New restrictions on transferring schools and pursuing additional programs at the same or lower educational level.
✅ Students already in the U.S. on September 15, 2026 may qualify for important transitional protections—but travel after that date could affect those protections.

📅 If you are planning to study in the U.S., continue your education, or travel around September 15, now is the time to review your immigration strategy.

🚨📰 Important Update for F, J, and I Visa Holders

The Department of Homeland Security (DHS) has issued a final rule that significantly changes how individuals in F-1, J-1, and I status will be admitted to the United States.

Key changes include:

• The end of “Duration of Status” (D/S). Admission will generally be granted for the length of the approved program, up to a maximum of four years.

• Extensions will require filing with USCIS. Students needing additional time to complete their academic program must file an Extension of Stay and will be subject to additional vetting, including biometrics.

• The F-1 grace period following completion of studies will be reduced from 60 days to 30 days.

• Additional restrictions on certain program changes and increased federal oversight.

According to DHS, these changes are intended to strengthen immigration integrity, enhance national security, and reduce abuse of the student visa system.

This is one of the most significant changes to student visa policy in decades and will have important implications for international students, educational institutions, and employers.

If you are currently in F, J, or I status, or are planning to apply for one of these visas, it is important to understand how these changes may affect your immigration plans.

🚨 Major Changes May Be Coming to the PERM Labor Certification Process. The U.S. Department of Labor has announced that it is preparing the first comprehensive update to the PERM Labor Certification regulations since 2004. The proposed changes are expected to modernize the recruitment process and strengthen protections for U.S. workers. According to the Department of Labor’s regulatory agenda, the proposal may include:

😱Updated labor market testing and recruitment requirements.
😎Enhanced employer compliance and recordkeeping obligations.
🧯Stronger safeguards in cases involving layoffs.
👮Revised recruitment standards to reflect today’s hiring practices.
🚨Additional measures to ensure fair and non-discriminatory recruitment.

In addition, separate proposed regulations could significantly increase prevailing wage requirements for PERM, H-1B, H-1B1, and E-3 cases if finalized. L

Traveling Internationally? Be Prepared: CBP Has Updated Its Electronic Device Search Policy.

Effective January 1, 2026, U.S. Customs and Border Protection (CBP) implemented updated guidelines regarding searches of travelers’ electronic devices at U.S. ports of entry. While CBP has long had authority to inspect phones, laptops, tablets, and other electronic devices at the border, the new directive expands certain enforcement powers and clarifies search procedures.

Some notable changes include:

• Expanded grounds for searching electronic devices, including additional national security and export-control concerns.
• In certain national security situations, CBP may conduct an advanced search without reasonable suspicion, provided higher-level approval is obtained.
• Additional guidance on detaining electronic devices, retaining data, and documenting searches.
• Clarification that CBP officers are expected to follow the laws and judicial precedent of the federal circuit where the search occurs, which may result in different standards depending on the port of entry.

What does this mean for travelers?
