La posible comisión de actos tales como el encarcelamiento u otra privación grave de la libertad física en violación de normas fundamentales de derecho internacional, junto con la persecución o desaparición de personas y as*****to, podría encuadrarse dentro de los crímenes de lesa humanidad definidos en el Artículo 7 del Estatuto de Roma, cuando dichos actos son cometidos como parte de un ataque generalizado o sistemático contra una población civil y con conocimiento de dicho ataque.

Es fundamental recordar que, bajo el Artículo 15 del mismo estatuto, el Fiscal de la Corte Penal Internacional está facultado para iniciar investigaciones proprio motu (de oficio) sobre la base de información recibida sobre crímenes de la competencia de la Corte. La impunidad de los agentes del Estado implicados en estas muertes bajo custodia no puede ser absoluta, y la comunidad internacional debe evaluar si existen las condiciones para activar los mecanismos de justicia global que garanticen la rendición de cuentas.

La transparencia y la justicia son indispensables para evitar que estas violaciones a los derechos humanos continúen bajo el velo de la opacidad.

La crisis humanitaria en El Salvador es imparable. Durante 52 meses bajo el régimen de excepción, al menos 537 personas han mu**to bajo la custodia del Estado sin haber sido vencidas en juicio. Lo que es aún más alarmante es que el 94% de estas personas no tenían perfil idas se apagaron en un contexto de total impunidad. La cifra real podría superar el millar, enfrentando un esfuerzo sistemático por ocultar información en los juicios masivos. Como sociedad civil, no podemos guardar silencio ante lo que constituye una posible violación sistemática a los derechos humanos.

Análisis Jurídico: El Estatuto de Roma y el rol de la Sociedad Civil
1. Relación con el Artículo 7 del Estatuto de Roma
El Artículo 7 del Estatuto de Roma define los crímenes de lesa humanidad. La situación descrita aquí podría encuadrarse en varias de las conductas prohibidas si se demuestra que son parte de un ataque generalizado o sistemático contra una población civil:

As*****to (Art. 7.1.a): La muerte de cientos de personas bajo custodia estatal, donde el Estado tiene la obligación de garantizar su integridad física, podría constituir as*****to.

Encarcelación u otra privación grave de la libertad física (Art. 7.1.e): La detención masiva de personas sin el debido proceso (sin ser vencidos en juicio) es una violación flagrante de normas fundamentales del derecho internacional.

Persecución (Art. 7.1.h): Si las detenciones y posteriores muertes son motivadas por el objetivo de eliminar o neutralizar a sectores específicos de la población, se configuraría como un acto de persecución.

2. El derecho de la Sociedad Civil a informar a la Fiscalía de la CPI
La Corte Penal Internacional (CPI) reconoce el papel vital de la sociedad civil y las víctimas en el proceso de justicia internacional:

Comunicación directa (Artículo 15): El Fiscal de la CPI tiene la facultad de iniciar investigaciones propio motu (por iniciativa propia) sobre la base de información sobre crímenes de la competencia de la Corte. La sociedad civil tiene el derecho y la facultad de enviar "comunicaciones" al Fiscal para proporcionar información sobre presuntos crímenes.

Mecanismo de denuncia: Toda persona, grupo u organización no gubernamental puede enviar información a la Oficina del Fiscal de la CPI. Estas comunicaciones sirven como insumos cruciales para que la Fiscalía evalúe si existe una "base razonable" para proceder con una investigación formal.

Responsabilidad: Ante la falta de justicia interna y la existencia de presuntas tácticas para "ocultar información en los juicios masivos", la comunicación ante la CPI se convierte en un mecanismo necesario para romper el ciclo de impunidad.

533 voces silenciadas: el precio de la impunidad del Estado en El Salvador
Detrás del número 533 no hay solo estadísticas; son 533 vidas que fueron confiadas al cuidado del estado salvadoreño, solo para terminar en tragedia tras las rejas. Estas personas murieron mientras estaban bajo custodia del Estado, les negaron su derecho fundamental al debido proceso y fallecieron sin haber sido condenadas en un tribunal de justicia.
Lo que es aún más desgarrador es que el 94 % de estas víctimas no tenían vínculos conocidos con la actividad de bandas.
Esto no es simplemente un fracaso del sistema de justicia; es una profunda crisis de rendición de cuentas. Cuando un estado detiene a individuos y los mantiene en condiciones que conducen a sus muertes, sin pruebas, sin juicio y sin transparencia, se convierte en cómplice de su desaparición.
La negativa de la actual administración a proporcionar plena transparencia, junto con el silencio sistémico de información en juicios masivos, apunta a una cultura deliberada de impunidad. Estas muertes están ocurriendo bajo la vigilancia del estado, y el silencio del estado dice mucho.
La justicia no se puede construir sobre los huesos de los inocentes. La verdadera seguridad nunca debe llegar a costa de los derechos humanos, ni debe otorgar al gobierno una licencia para operar por encima de la ley. Debemos exigir la verdad, rendición de cuentas por estas muertes prevenibles y el fin inmediato del ciclo de impunidad que sigue arrojando una sombra oscura sobre El Salvador.

The images in 23.jpg tell a story that the official narrative refuses to acknowledge: elderly citizens, including individuals aged 64, 72, and 76, who were labeled as gang members and subsequently died while under state custody. It is estimated that the total number of deaths within the prison system could reach two thousand or more.

Perhaps these faces are hidden because their reality is not "popular." However, the truth does not stop being the truth simply because it is unpopular or inconvenient to the state's carefully curated image. When propaganda masks the suffering of the most vulnerable, it ceases to be a government policy and becomes an instrument of silence.

Truth remains truth, regardless of how much it contrasts with the polished marketing of a political model.

Yeferson, a 23-year-old who was not a gang member, entered the prison system healthy but suffered profound physical trauma while incarcerated.

He was subjected to torture, which has become a recurring cause of the severe, acquired health complications seen in these cases.

Specifically, Yeferson developed kidney failure that necessitated dialysis—a direct result of sustained physical beatings in prison that caused systemic organ damage and failure.

After his release, he ultimately died from multiple organ failure (sepsis), a tragic outcome caused by diseases acquired in prison that were left untreated.

Legal Grounds for Justice and Accountability
The pattern of prisoners acquiring life-altering kidney failure due to repeated beatings and torture while in state custody represents a clear violation of international law:

Crimes Against Humanity (Rome Statute, Article 7): The systematic use of physical beatings leading to organ failure and death constitutes "torture" and "other inhumane acts" under Article 7. When committed as part of a widespread or systematic attack against a civilian population, these acts fall under the jurisdiction of the International Criminal Court.

Fundamental Human Rights: Under the International Covenant on Civil and Political Rights (ICCPR), the state has an absolute duty to protect the health and dignity of all persons deprived of their liberty. The environment described in 19.jpg, where torture directly leads to chronic, untreated kidney failure and death, constitutes a flagrant breach of these protections.

There must be justice for Yeferson and all others who have been irreparably damaged by this systematic cycle of violence and medical neglect. The international community must hold those responsible accountable for these crimes against humanity, which are now destroying the lives of young, innocent people within the state’s prison system.

Rafael Lopez Castellon, a 53-year-old miller, was detained in June 2022 and died in the Mariona prison.

In a chilling act of state erasure, he was buried in a mass grave under an assumed identity, effectively disappearing him from his family and the public record until his eventual exhumation in September 2022.

While official forensics cited "Pulmonary Edema," photographic evidence clearly shows bruising on his face—a hallmark of the violence and torture occurring behind prison walls.

Rafael was not a gang member, yet his life was extinguished and his identity discarded by a state apparatus that operates with total disregard for the rule of law.

Legal Imperative: Accountability Does Not Expire
The actions taken against Rafael Lopez Castellon—specifically the forced disappearance and extrajudicial execution—are not subject to the limitations of time or political cover.

Crimes Against Humanity (Rome Statute, Article 7): The systematic practice of extrajudicial killing, combined with the forced disappearance of detainees into mass graves, constitutes a crime against humanity. Under the Rome Statute, these acts do not have a statute of limitations.

Individual Criminal Responsibility: State agents and officials who order, facilitate, or commit these acts are personally and individually criminally responsible. The principle of nullum crimen, nulla poena sine lege does not shield perpetrators of crimes against humanity from international or domestic prosecution.

Non-Prescription: Under international human rights law and the jurisprudence of the Inter-American Court of Human Rights, crimes against humanity and forced disappearances are imprescriptible. There is no legal refuge for those who believe they can hide their crimes in mass graves; the state's accountability is permanent.

Conclusion
The burial of Rafael in a mass grave is an explicit attempt to hide the truth, but it has failed. We demand an immediate, transparent, and independent investigation into the entire system of mass graves used to bury the victims of the State of Exception. The law is clear: these are not administrative oversights; they are profound violations of the Rome Statute that demand international justice. The agents of the state responsible for this will be held to account, regardless of the time passed, because crimes against humanity do not expire.

Rember Antonio Valladares Portillo, a 40-year-old evangelical pastor and informal merchant, was detained in March 2024 and held for two years in the Mariona prison.

Despite having no prior history of chronic illness, he acquired Chronic Renal Insufficiency while incarcerated, which went untreated by the state until it became fatal in March 2026.

A particularly harrowing aspect of this case is that his wife and sister remain imprisoned for the same case, illustrating the state’s practice of tearing entire families apart under the guise of the State of Exception.

The government's propaganda machine ignores individuals like Rember, who was not a gang member, as his life story directly contradicts the state’s narrative of security and justice.

Violations Under the Rome Statute
The systematic destruction of the Valladares Portillo family and Rember’s preventable death may constitute crimes against humanity under Article 7 of the Rome Statute of the International Criminal Court:

Murder (Article 7(1)(a)): The state's failure to treat a life-threatening condition—acquired specifically due to the environment of the state’s own prison system—constitutes an act of lethal neglect that may meet the threshold for murder.

Persecution (Article 7(1)(h)): The incarceration of multiple family members for the same case, despite their status as innocent civilians and community leaders, indicates a pattern of targeted persecution against specific households.

Other Inhumane Acts (Article 7(1)(k)): The broader suffering inflicted upon Rember and his family, who remain detained, constitutes an inhumane act causing profound mental and physical suffering.

Despite not being a gang member, he spent a year and a half in the Izalco prison, where his pre-existing diabetes was met with catastrophic neglect. During his detention, he underwent a toe amputation without his family even being notified, and he ultimately passed away in December 2024 due to complications from a diabetic foot—a tragic outcome directly fueled by the state’s denial of his essential medical treatments and medicines.

The government's propaganda continues to aggressively broadcast images of tattooed gang members to maintain a veneer of security, intentionally obscuring the reality that innocent, hardworking citizens like Santos are being subjected to conditions that lead to their preventable deaths.

Violations Under the Rome Statute
The circumstances surrounding the death of Santos Navarro may constitute crimes against humanity under Article 7 of the Rome Statute of the International Criminal Court:

Murder (Article 7(1)(a)): The systematic denial of life-saving medical care to a detainee suffering from a chronic, manageable condition like diabetes, leading directly to his death, represents an intentional act of omission that may meet the criteria for murder when part of a widespread or systematic attack against a civilian population.

Torture (Article 7(1)(f)): Performing surgical amputations without family consent and withholding necessary care from a vulnerable individual constitutes severe physical and mental suffering, qualifying as torture and cruel treatment.
