Originating from a time with minimal consumer protections, it required buyers to exercise due diligence to avoid being misled, as legal recourse for defective products was limited. While modern consumer laws often mitigate the strict application of this principle by requiring sellers to disclose defects or honor warranties, the essence of caveat emptor remains relevant. Buyers must remain vigilant and informed in their purchasing decisions. Ultimately, caveat emptor serves as a reminder that awareness and research are key to making wise choices, especially in private sales or high-value transactions.

(MANDATORY THAT EVERY FOREIGN EMPLOYEE POSSESS A VALID WORK PERMIT)

If you are an employer, an organisation, or run a Business entity within South Sudan?

Do you have a foreign National within your workforce?

The new Labour Circular imposes an obligation to provide legal work status to every foreign employee you hire; otherwise, severe penalties may be imposed, including
* Prosecution
* Fines
* closure of the establishment
* deportation

What can you do to comply with the new Labour order?

1. Verify the legal work status of all foreign employees
2. Review your employment Contracts, policies to ensure they are in full compliance with Labour Regulation 2023
3. Reduce the foreign workforce with national employees

توجيهات جديدة من وزارة العمل

الزام كل العاملين الاجانب بالحصول علي تصريح عمل ساري المفعول

إذا كنت صاحب عمل، أو مؤسسة، أو تدير كيانًا تجاريًا في جنوب السودان؟

اذا كان يعمل لديك مواطن أجنبي؟

يُلزم تعميم العمل الجديد بتوفير وضع عمل قانوني لكل موظف أجنبي تُوظفه؛ وإلا، فقد تتعرض لاجراءات و عقوبات صارمة، بما في ذلك:
* الملاحقة القضائية
* الغرامات
* إغلاق المنشأة
* الترحيل

ما الذي يمكنك فعله للامتثال لقانون العمل الجديد؟

1. التحقق من الوضع القانوني لجميع الموظفين الأجانب
2. مراجعة عقود وسياسات العمل لديك للتأكد من امتثالها التام لقانون العمل لعام 2023

⚖️ البلاغ والشكوى في القانون

📘 أولًا: البلاغ
هو تبليغ او إخبار السلطات (النيابة أو الشرطة) بوقوع جريمة ما في دائرة الاختصاص.
يجوز لأي شخص مكلف بحفظ الامن تقديمه، حتى لو لم يكن مجنيًا عليه.
يمكن للشرطة فتحها ان كانت من البلاغات المطلقة (اي التي بجوز للشرطة فتحها دون اذن للنيابة) مثل القتل والنهب والسرقة واللاذي الجسيم
وتشترط رفع الاوراق للنيابة العامة خلال ٢٤ ساعة وهي التي تقرر التحقيق أو الحفظ.
لايجوز التنازل فيها الا فيما يختص بالحق الخاص اما الحق العام فتباشره للنيابة وتقدمه للمحاكمة

📘 ثانيًا: الشكوى
هي حق شخصي للمجني عليه او وكيله في بعض الجرائم التي لا تتحرك فيها الدعوى إلا بناءً على طلبه، مثل جرائم الزنا أو اشانة السمعة والاحتيال.
✋ تسقط الدعوي بالتسوية أو التنازل عنها..

🔍 الفروق الجوهرية:

البلاغ
تكون ابلاغ سلطات والاحتجاج في الحق العام تقدم للشرطة وتباشرها النيابة العامة ضد الشخص نيابة عن المجتمع بغرض حفظ الامن والنظام العام
الشكوى
تكون احتجاج للحق الخاص مقدمها أي شخص المجني عليه أو وكيله المجني عليه بموجب
الأثر تحريك التحقيق شرط لتحريك الدعوى تحريك الدعوى أمام المحكمة

📍 خلاصة القول:
🔹 البلاغ هوإخطار السلطات بوقوع جريمة.
🔹 الشكوى هي طلب تحريك الدعوى في جرائم خاصة.
