INCURSION OF UGANDAN TROOPS INTO SOUTH SUDAN’S TERRITORY (KAJO-KEJI COUNTY)
The recent statements made by the Commissioner of Kajo-Keji County, Jackson Wani Mule, regarding the continued incursions of the Ugandan People’s Defence Forces (UPDF) into South Sudanese territory raise serious legal and diplomatic concerns that require urgent attention.
Under international law, the principle of territorial integrity and sovereignty is sacrosanct. Article 2(4) of the Charter of the United Nations (1945) prohibits the threat or use of force against the territorial integrity or political independence of any state. Likewise, Article 3(b) and (c) of the Constitutive Act of the African Union enshrines the principle of respect for borders existing on achievement of independence (uti possidetis juris). Any unauthorized military presence by one state on the territory of another constitutes a violation of these principles and risks destabilizing bilateral relations.
South Sudan and Uganda, as members of both the United Nations and the African Union, are bound by these provisions. Precedents from the International Court of Justice (ICJ) notably the Case Concerning Armed Activities on the Territory of the Congo (Democratic Republic of the Congo v. Uganda, 2005) are instructive. In that judgment, the ICJ found Uganda internationally responsible for violations of sovereignty, territorial integrity, and human rights arising from its military presence in the Democratic Republic of Congo without consent. The Court held that even if security concerns are alleged, unilateral incursions cannot justify violations of another state’s sovereignty.
Similarly, the ICJ Judgment in the Burkina Faso/Mali Frontier Dispute (1986) reaffirmed that territorial disputes must be resolved peacefully through negotiations, arbitration, or judicial settlement, not through military occupation.
In the present case, while diplomatic channels between Juba and Kampala remain open, the reported deployment of Ugandan forces in forested areas of Kajo-Keji without coordination or consent undermines good faith negotiations and poses a threat of escalation. It also risks displacement of civilians, in contravention of Article 4(h) of the AU Constitutive Act, which prohibits forceful displacement of populations, and Article 9 of the International Covenant on Civil and Political Rights (ICCPR), which protects the right to liberty and security of persons.
South Sudan has a duty to protect its citizens and preserve its territorial integrity. However, as a young nation committed to regional peace, it must pursue remedies within the framework of law. I recommend:
1. Activation of the Joint Military Committee already announced by Juba and Kampala, with immediate deployment of joint observers to disputed areas.
2. Formal protest through diplomatic note invoking the principle of peaceful settlement of disputes under Article 33 of the UN Charter.
3. Referral to IGAD and the African Union Border Programme (AUBP) for mediation and technical demarcation of contested boundaries.
4. Preservation of evidence of incursions, in the event that South Sudan must seek adjudication or advisory opinion from the International Court of Justice, following the precedent set in other African border disputes.
Uganda’s reported deployments in Kajo-Keji, are inconsistent with international law, African regional instruments, and the spirit of brotherhood between the two nations. South Sudan must assert its sovereignty through lawful, peaceful, and diplomatic means, while safeguarding the rights and security of its citizens in the affected areas.

*A PATHWAY TO EXCELLENCE AND IMPACT (DILIGENT SERVICE) *
Diligent service is the unwavering commitment to fulfilling one’s responsibilities with care, integrity, and consistent effort. It goes beyond mere duty and embraces a spirit of excellence, reliability, and purpose. In any profession, community role, or personal endeavor, diligent service is not just an ideal; it is a practice that shapes character, earns trust, and drives meaningful results.
At its core, diligence is about being thorough and persistent. A person who serves diligently pays attention to detail, follows through on commitments, and does not take shortcuts. Whether in a courtroom, classroom, office, or field, such a person brings full presence and focus to their tasks. They are not motivated solely by external rewards but by an internal compass of responsibility and purpose.
Diligent service is particularly crucial in leadership and public service. A leader who is diligent does not just make decisions; they consult, research, listen, and act with foresight. Their service is marked by consistency, humility, and accountability. In many developing regions, including much of Sub-Saharan Africa, communities yearn for such leadership, people who serve not to be seen or praised, but to bring real, lasting transformation.
In the legal profession, for example, diligence is essential to upholding justice. A diligent lawyer investigates thoroughly, prepares rigorously, and advocates tirelessly. They understand that each case is not just paperwork; it represents a person’s life, rights, and dignity. Diligence ensures that no one is denied justice through neglect or incompetence.
It also extends to entrepreneurship and private enterprise. In business, diligence builds credibility and customer trust. It fosters innovation and long-term growth, especially in environments where resources are limited and competition is fierce. An entrepreneur who serves clients diligently delivers not just products or services, but reliability and value.
Moreover, in community work and volunteerism, diligence is the silent strength that sustains efforts even when applause fades. Volunteers and grassroots leaders who serve diligently often face obstacles, from lack of funding to political resistance. Yet, it is their consistent, quiet labor that plants the seeds of change.
However, diligent service is not without challenges. It requires discipline, resilience, and often, sacrifice. In a world that often rewards speed over depth and popularity over substance, those who choose diligence may seem out of step. But over time, diligent service yields results that speak for themselves solid institutions, empowered communities, and enduring legacies.
Ultimately, diligent service is a calling to live and work with integrity. It reminds us that how we do our work matters as much as what we do. It invites us to lead with purpose, serve with heart, and strive for excellence not just for personal gain, but for the good of others.
In every field, diligent service is a mark of true professionalism and character. It builds trust, earns respect, and transforms societies. In a world in need of authentic leadership and faithful service, diligence is not just a virtue, it is a necessity.

Condemnation of Gang R**e in Shirkat and Appeal for Protection of Victim’s Dignity
Modi Law Chambers unequivocally condemns the heinous and criminal act committed by a group of seven boys who gang-raped a 16-year-old girl in Shirkat, a business suburb in Juba, South Sudan.
This act of violence against a minor is not only a grave criminal offense under South Sudanese law, but also a brutal violation of human rights, morality, and the values that bind us as a society. Such crimes must be met with swift and uncompromising justice.
We call upon the relevant authorities to ensure the immediate arrest, thorough investigation, and prosecution of all those involved. There must be no safe space for perpetrators of sexual violence in our communities.
Furthermore, we are deeply concerned about the circulation of videos and images related to this horrific crime. Sharing such content violates the privacy, dignity, and wellbeing of the victim and causes continued psychological harm.
We therefore strongly appeal to the public to:
• Immediately stop sharing or distributing any videos or images of the incident;
• Report such content to appropriate platforms and authorities for removal;
• Show empathy, restraint, and solidarity by protecting the identity and dignity of the survivor.
Let us all stand together in support of victims of sexual and gender-based violence. As a legal institution committed to justice and human rights, Modi Law Chambers remains steadfast in advocating for accountability, reform, and the protection of vulnerable persons.

Modi Law Chambers welcomes and commends the launch of the South Sudan Judiciary’s Five-Year Strategic Plan (2025–2029) as a timely and necessary roadmap for strengthening the rule of law, promoting judicial independence, and enhancing access to justice for all citizens.
