An important perspective to keep in mind when settling out of court: compromise is inevitable. You may be legally entitled to, say $100,000.00 but it will take, maybe 2 years to obtain a favourable ruling. If you are prepared to collect, say, $60,000.00 in 3 months, you can consider it a "worthwhile bargain/risk" in that you can quite possibly recoup the $40,000.00 within the next 21 months. Does it make sense to you personally? If so, offer the settlement to the other side.
