Inheriting a house in Poland? Check whether it is burdened with a reverse mortgage

Inheriting real estate is usually associated with financial security and the continuation of family history. In practice, however, heirs increasingly discover that the inherited house is burdened with an obligation towards a bank, or that a life estate agreement was concluded during the owner’s lifetime.

This is a very important distinction.

In the case of a reverse mortgage, the property still forms part of the estate, but it is burdened with a debt that the heirs must settle with the bank. The family may then, among other options:

✅ repay the debt and keep the property;
✅ sell the house, repay the bank, and divide the remaining amount;
✅ allow the creditor to satisfy its claim from the property.

The situation is different in the case of a life estate agreement or lifetime annuity arrangement. In such a case, ownership of the property may have been transferred during the senior’s lifetime, which means that the house may not form part of the estate at all.

That is why, after the death of a loved one, it is worth acting quickly and:

🔹 checking the land and mortgage register, especially Sections III and IV;
🔹 determining whether there is a reverse mortgage agreement or a life estate agreement;
🔹 contacting the bank or financial institution;
🔹 formally confirming the acquisition of inheritance;
🔹 remembering tax deadlines, including the SD-Z2 notification.

A lack of quick action may lead to unnecessary stress, additional costs, and the risk of making the wrong decisions.

This is where the concept of Inheritance Estate Accounting (regulated under Articles 1039–1043 of the Polish Civil Code) comes into play. Its core purpose is simple: to ensure fairness and equal treatment among statutory heirs.

💡 How does it work in practice?
If one heir received significant lifetime benefits (like real estate or large cash gifts) from the deceased, the value of those gifts is added back to a "hypothetical" total estate. When the final assets are distributed, that heir’s share is reduced because they already received a portion of their inheritance "in advance."

Key facts you need to know:
1️⃣ It’s a balancing mechanism: It doesn’t create a new financial claim; it simply adjusts the final shares during the division of the estate.
