When hiring employees in Poland, companies must decide which legal framework will govern the cooperation.

The two most common forms are the employment contract:
✔️ (umowa o pracę)
✔️ and the civil law contract (umowa zlecenie).

While both are lawful and frequently used in business practice, they are regulated differently and create different legal and financial consequences.

An employment contract is governed by the Polish Labour Code. It provides statutory employee protection, including paid annual leave, sick leave, notice periods and a guaranteed monthly minimum wage.

A civil law contract is regulated by the Civil Code. It is based on task performance rather than working time, subject to a statutory minimum hourly rate and does not grant paid leave under labour law provisions.

From an employer’s perspective, the choice of contract impacts:
▫️total employment costs
▫️social security contributions
▫️termination procedures
▫️the level of employer liability
▫️overall compliance obligations

Selecting the appropriate structure should reflect the company’s business model, operational needs and regulatory responsibilities.

As of 1 February 2026, KSeF 2.0 (Poland’s National e-Invoice System) is being introduced, with mandatory implementation applied in phases.

If your company invoices in Poland, this change affects how invoices are issued and handled — even if the company is managed from abroad.

What does KSeF mean in practice?
• invoices will be issued as e-invoices within the KSeF system
• companies should prepare their invoicing and accounting processes
• access rights and authorisations must be properly assigned

As of beginning 2026, the minimum wage in Poland for a full-time employment contract is PLN 4,806 gross per month. That’s the lowest salary an employee on a contract of employment must get.

But if you work on an umowa zlecenie (contract of mandate) or similar civil law contract, the law sets a minimum hourly rate and that’s PLN 31.40 gross per hour.

So remember:
📍 Employment contract = 4,806 PLN gross/month minimum
📍 Contract of mandate = 31.40 PLN gross/hour minimum

Many entrepreneurs assume that once a company is registered, VAT status comes automatically.
❗️In Poland, it doesn’t.

VAT registration is a separate procedure, reviewed by the tax office.
They assess:
✔️the type of activity
✔️the business model
✔️ the level of VAT risk
✔️documentation and timing

In some cases, applying too early can raise unnecessary questions.
In others, delaying VAT registration can create serious tax consequences.

This is why VAT should never be treated as a checkbox.
It’s a decision — not a formality.
