📖 Background of the Case
رسپانڈنٹ/مدعی نے پٹیشنر کے خلاف 1,20,00,000 (ایک کروڑ بیس لاکھ) روپے کی وصولی کا دعویٰ زیر آرڈر 37 CPC دائر کیا۔ پٹیشنر کو مطلوبہ رقم کی مساوی ضمانتی مچلکے (Surety Bonds) جمع کروانے کی شرط پر دفاع (Leave to Defend) کی اجازت دی گئی۔
پٹیشنر متعدد مواقع ملنے کے باوجود شرط پوری کرنے میں ناکام رہا، جس پر عدالت نے مشروط دفاع کا حکم واپس لے لیا۔ بعد ازاں پٹیشنر نے مدعی کے گواہان پر جرح کی اجازت کے لیے درخواست دی جو ٹرائل/ڈسٹرکٹ کورٹ نے خارج کر دی۔ پٹیشنر نے اس کے خلاف ہائی کورٹ میں آئینی درخواست (Writ Petition) دائر کی۔ ہائی کورٹ کے آفس نے اعتراض اٹھایا کہ آئینی درخواست ناقابلِ سماعت ہے اور پٹیشنر کو سول ریویژن (Civil Revision) دائر کرنی چاہیے۔

----S. 115 & O.###VII---Constitution of Pakistan, Art. 199---Closure of right to cross examine the witnesses assailed before High Court---Remedy---Whether constitutional petition or civil revision?---Petitioner filed constitutional petition by calling in question order passed by District Court, whereby right of the petitioner to cross examine witnesses of respondent / plaintiff had been closed for his failure to comply with the condition mentioned. in the leave granting order The office of High Court raised the objection on maintainability of constitutional petition and directed to avail proper remedy i.e. Civil Revision---Validity--- Perusal of S.115(1) C.P.C. shows that remedy of civil revision is available against any order, appeal where-against is not available under the law--- In the present case, respondent filed a suit under O.###VII, C.P.C. for recovery of Rs.1,20,00,000/- against the petitioner which was contested by him and he was granted leave to defend subject to furnishing of the surety bonds equivalent to the amount claimed in the suit i.e. Rs.1,20,00,000/-, however, as said condition was not complied with by the petitioner, despite availing various opportunities; hence, the said order was subsequently recalled; where-after the petitioner submitted an application before the Trial/District Court seeking permission to cross examine witnesses of respondent / plaintiff---The said id application had been dismissed through the impugned order--- No appeal is maintainable against said order, therefore, in terms of S.115(1), C.P.C. ordinarily a revision petition is to be filed against such an order as dismissal of application, vide impugned order, was a final order as regards the decision of said application and case decided in terms of S.115, C.P.C., therefore, could be called in question through revision petition and while hearing the said revision on merits, the question whether the matter falls within the three grounds provided for exercise of civil revision or not would be decided on its own merits in accordance with law---Office objection was sustained accordingly.
