Order XXIII Rule 1, CPC — Withdrawal of Suit & Bar on Subsequent Proceedings

In Civil Revision No. 80-P of 2017, the Peshawar High Court, vide order dated 07.10.2025, passed an order in a civil matter concerning withdrawal of suit. The said order was assailed before the Hon’ble Supreme Court of Pakistan through C.P.L.A. No. 5071 of 2025 (Sohail Islam & another v. Saadullah Khan & others)

The C.P.L.A. was decided on 05.01.2026 by Hon'ble Mr. Justice Shahid Bilal Hassan, wherein the Hon’ble Court examined the legal consequences of withdrawal of an earlier suit without seeking permission to institute a fresh one under Order XXIII Rule 1, CPC.

The Court reaffirmed the settled principle that where a suit is withdrawn simpliciter, without leave of the Court, a subsequent suit on the same cause of action is barred. A withdrawal allegedly founded upon a private arrangement, which neither receives judicial recognition nor forms part of the Court’s order, does not alter the legal character of such withdrawal.

It was further observed that failure to challenge the withdrawal order operates as an estoppel against re-agitating the same cause of action, and that a subsequent suit would also be hit by the bar of limitation.

Lawyers' Medical Rights Petition Filed in Peshawar High Court

A writ petition is filed by Hamza Khurshid Advocate in the Peshawar High Court represented by the chambers head Barrister Babar Shahzad Imran and Barrister Mustafa Durrani seeking implementation of Section 11 of the Lawyers Welfare and Protection Act, 2023. The petition argues that lawyers in Khyber Pakhtunkhwa are being denied medical facilities guaranteed under the Act.

Section 11 entitles advocates, spouses, parents, and minor children to medical treatment at par with gazetted officers (BPS-17 & 18) in government hospitals upon presentation of official cards and Bar Council verification.

The petition seeks: Immediate implementation of Section 11 in Parity with Punjab, where the Lahore High Court has directed implementation of the same

The bench comprising Justice Syed Arshad Ali and Justice Faheem Wali has noticed the petition to the respondents, including Federation of Pakistan and Provincial Government of KP for comments.

Pleased to share that my application under Order 7 Rule 11 CPC has been accepted, leading to the rejection of the plaint filed against our client. A strong reminder that procedural law is not just a formality—it safeguards justice by filtering out meritless claims at the very outset.

Every case is a challenge, every argument an opportunity, and every decision a lesson.

📌 State the Facts Properly: Present details in a logical order without exaggeration.

⚖ Mention Relevant Laws: Refer to legal provisions that support your claim.

🚨Clearly Demand Action: Specify what you want and set a reasonable deadline.

✍ Maintain a Professional Tone: No threats, no emotions, just facts and legal standing.

📩 Send Through Proper Channels: Always ensure proof of delivery.

👨‍⚖️ Consult a Lawyer: Last but not the least, always consult and hire a professional. A well drafted notice can make all the difference.
