Can a business loss lead to imprisonment? 🚨 (A Success Story of Strategic Legal Drafting)
A few days ago, a distressed client approached me. He is a reputable trader in Karachi who had entered into a mutual business partnership with an investment of Rs. 6,000,000/-. Unfortunately, due to market conditions, the business suffered heavy financial losses.
Since it was a shared partnership, both parties were legally and morally responsible for the loss. However, instead of handling the situation through proper business channels, the complainant misused police influence. They forcefully extracted 7 signed cheques from my client under severe duress and threats, and subsequently registered an FIR at P.S. Shara-e-Faisal, Karachi.
The local police began conducting frequent raids at my client's home and workplace, putting his social reputation and dignity at stake.

I raised three pivotal grounds in the draft:
1️⃣ Unexplained Delay in FIR: The alleged incident took place on June 12th, but the FIR was registered on June 20th. This 8-day delay without any plausible explanation created reasonable doubt.
2️⃣ Forceful Extraction: The cheques were not issued voluntarily to discharge a legal liability. They were extracted under police pressure, which squarely brought the case under the ambit of 'Further Inquiry' (U/S 497(2) Cr.P.C).
3️⃣ Purely Civil Nature: The dispute was strictly a civil matter involving the rendition of business accounts, which was maliciously converted into criminal litigation to blackmail the client.
The Victory (Result):
Recognizing the strength of our written grounds and oral arguments, the Honorable Court was pleased to ALLOW the Pre-Arrest Bail (BBA)! My client was saved from illegal detention and public humiliation.
