🤔ایک عام تاثر یہ ہے کہ "برانڈ"، "لوگو" اور "ٹریڈ مارک" الگ الگ چیزیں ہیں۔ لیکن دی ٹریڈ مارکس آرڈیننس، 2001 (Section 2, Clause xxiv) کے تحت قانون کی نظر میں یہ سب ایک ہی "مارک" (Mark) کی تعریف میں آتے ہیں۔بہت سے کاروباری حضرات سالوں کی کڑی محنت، دن رات کے سرمائے اور خون پسینے سے مارکیٹ میں اپنا نام بناتے ہیں۔ لیکن رجسٹریشن نہ ہونے کی وجہ سے کوئی دوسرا شخص اس نام کو اپنے اکاؤنٹ میں رجسٹر کروا کر پورا چلتا ہوا کاروبار ہتھیا لیتا ہے۔قانون کا ایک سادہ اور اٹل اصول ہے: "جو پہلے رجسٹر کروائے گا، قانون اسی کو مالک مانے گا—نہ کہ اسے جس نے محنت کی ہو۔"اپنی سالوں کی محنت کو چوری ہونے سے بچانا اور اپنے نام کو قانونی تحفظ دینا ہی کسی بھی کامیاب بزنس کا پہلا اور اہم ترین قدم ہے۔
