How to get Canada Marriage visa From Pakistan

Marriage to a Pakistani Citizen

Every country has its own laws that apply to its citizens marrying a person from a different country. Getting married to a Pakistani citizen with the goal of eventually bringing them to Canada to live is a process with many steps.

If you want to bring your Pakistani spouse or partner to live in Canada, you must then file a sponsorship application for them to become a permanent resident. If they would like to visit you in Canada while their application is in process, they must also apply for a visitor visa. Pakistani Marriage Basic Requirements
Legal Marriage age in Pakistan for a woman is 16 years old and for a man is 18 years old. If you want to marry before this age you require a Guardian Permission. For Registration of Marriage you require Pakistani ID, Form B or Educational Certificate for verification of Date of Birth.

In case the spouses don't have such documents then their photo graph would be fixed on the marriage papers and some other person could verify their particulars.

The woman will further swear through affidavit that she has no subsisting marriage.

In case one of the parties had any marriages in the past, then divorce decree or death certificate of spouse would be required where applicable.

For marriage to be performed at least two witnesses must be present required.

A marriage certificate is known as “nikanama” in Pakistan. It is allowed for a foreign woman to marry a Pakistani man in Pakistan. Although not required to change her religion if she is either a Christian or a Jew, it is recommended that she does if the man is a Muslim. It is recommended that a lawyer be present on wedding so that he can guarantee that all clauses of Muslim Family Laws Ordinance are satisfied. The marriage certificate also needs to be stamped by the Pakistan Foreign Office.

There are two types of marriages in Pakistan

Court Marriage
This is held in the district court in presence of a judge. A nikanama is signed.

Religious Marriage
This is when a local maulvi / imam (priest) conducts the marriage in an Islamic manner, usually in the house or a hotel.



Family Members
If your Pakistani spouse has dependent children, this does not affect the Pakistani Marriage document application.

If you have dependent children, they have no effect on the application to marry a Pakistani citizen.

How to get USA Marriage Visa from Pakistan

Every immigrant visa case is different, so it is difficult to estimate how long the process will take for a specific individual. In general, there are three factors that contribute to the processing time required:

Time Required to Process a Petition
The time it takes for USCIS to approve a petition varies according to the type of petition and the specific USCIS office involved. Estimates for specific USCIS offices are available here.

Time Required to Process through the National Visa Center and the U.S. Embassy or Consulate
Once a petition is approved, if it is in an immediate relative category or has a current priority date, it is largely up to you how long it takes to get an interview appointment. The more quickly you follow the instructions provided by the National Visa Center (NVC) and submit all requested documents, the sooner an appointment can be scheduled. Appointments are usually scheduled for the month after all documents are submitted. Visas are normally available within a few days of the interview.

Time for Case to Become Current
For certain categories of immigrants, the law allows only a limited number of visas to be issued each year. These cases are processed strictly in order of the date the petition was filed (this is the priority date). Visas cannot be issued until an applicant's priority date is reached (the application becomes current). This could take several years. While it is impossible to say exactly how long it will take, the Visa Bulletin, published monthly, lists the priority dates currently being processed, which may provide an indication of how much time remains.

Note: When the petitioner naturalizes, all F2A petitions (spouse or minor child of a permanent resident) are automatically converted to IR1 (spouse of U.S. citizen) or IR2 (child of U.S. citizen) petitions. These visa categories are not subject to the visa quota system and will, therefore, always have visas available for the beneficiaries' use if they qualify for visa issuance. How to apply UK Spouse visa from Pakistan
To apply as a partner, you and your partner both need to be 18 or over.

Your partner must also either:

be a British citizen

have settled in the UK (they have ‘indefinite leave to remain’ or proof of permanent residence)

have refugee status or humanitarian protection in the UK

You and your partner must intend to live together permanently in the UK after you apply.

What you’ll need to prove

You must be able to prove one of the following:

you’re in a civil partnership or marriage that’s recognised in the UK

you’ve been living together in a relationship for at least 2 years when you apply

you are a fiancé, fiancée or proposed civil partner and will marry or enter into a civil partnership in the UK within 6 months of arriving

You also need to prove you:

have a good knowledge of English

can financially support yourself and your dependants

If you do not meet these requirements you may still be able to apply for a visa or extend your permission to stay if:

you have a child in the UK who is a British citizen or has lived in the UK for 7 years and it would be unreasonable for them to leave the UK

there would be very significant difficulties for you and your partner if you lived together as a couple outside the UK that could not be overcome

it would breach your human rights to stop you coming to the UK or make you leave

If you’re applying as a fiancé, fiancée or proposed civil partner

You must prove that:

any previous marriages or civil partnerships have ended

you plan to marry or become civil partners within 6 months of arriving in the UK

You will not be able to work during your engagement.

How long you can stay

You’ll get permission to stay for 2.5 years, or for 6 months if you’re applying as a fiancé, fiancée or proposed civil partner.

After this you’ll need to apply to extend your stay.

How to apply

You’ll need to prepare information and send documents with your application.

How you apply depends on whether you’re outside or in the UK.

Outside the UK

You must apply online from outside the UK. You must also complete Appendix 2.

There’s a different way to apply in North Korea.

In the UK

You must apply online if you meet all of the following requirements. You:

can prove your knowledge of English

meet the minimum income requirement

currently have permission to be in the UK

If you do not meet all 3 requirements, download and fill in application form FLR(FP). Send it to the address on the form.

Get a same-day decision

You may be able to get a same-day decision at a premium service centre.

Book an appointment either:

as part of your online application

using the appointment booking service if you’re applying using application form FLR(FP)

If you cannot pay the fee

You must apply by post.

Fill in application form FLR(M) and the fee waiver request form (appendix 1) if you cannot pay the fee because you:

do not have a place to live and cannot afford one

have a place to live but cannot afford essential living costs like food or heating

have a very low income and paying the fee would harm your child’s wellbeing

Send both documents to the address on form FLR(M).

How to Get a Canadian Student Visa
In order to study in Canada, you will need to obtain a Canadian study permit, which serves as a Canadian student visa for the duration of your stay. You do not need a Canadian study permit if your course or program lasts six months or less. Nonetheless, it may be a good idea to apply for a permit before you come to Canada anyway – otherwise if you decide you want to continue your studies in another program, you’ll need to leave Canada to apply for a study permit through a visa office.
In order to study in Canada, you will need to obtain a Canadian study permit, which serves as a Canadian student visa for the duration of your stay. You do not need a Canadian study permit if your course or program lasts six months or less. Nonetheless, it may be a good idea to apply for a permit before you come to Canada anyway – otherwise if you decide you want to continue your studies in another program, you’ll need to leave Canada to apply for a study permit through a visa office.

Once you have a Canadian study permit, you can apply to renew it from within Canada if you decide to continue your studies. For full-time students registered at an accredited higher education institution, a study permit also allows you to work part-time on campus. You may also be able to work off-campus, work as a co-op or intern as part of your program, stay in Canada as a permanent resident or find work after you graduate.

Applying for a Canadian study permit
You can apply for a Canadian study permit either online or through a paper application, which can be obtained from the Citizenship and Immigration Canada (CIC) website. Paper applications typically take about twice as long, and it’s always recommended to check the processing times well in advance. To apply online, you’ll need a credit/debit card and the ability to create electronic copies of your supporting documents (i.e. using a scanner or camera). The visa office in your country will provide specific instructions about which documents you need to provide; this can vary depending on your location. If you need assistance, you can get help at your nearest visa application center (VAC).

The process for obtaining a Canadian student visa is as follows:

You must first obtain a standardized letter of acceptance from a recognized higher education provider. Students studying in Quebec must also apply for a certificate of acceptance, known as a CAQ, from the government of Quebec. You must acquire this before you are permitted to apply for a study permit. You can get this online, by printing out a form, or by requesting a paper form from your university, which will also provide advice on this subject.

The next stage is to get a Canadian student visa application package, either from the CIC website or by contacting your local visa office, or the Canadian embassy or consulate in your home country. You may also need to obtain a temporary residence permit if you are from a designated country (find out if you need to get one here), but this will not complicate matters too much as it’ll be processed at the same time as your study permit application.

In order to get your application package you’ll need to answer a few questions about yourself on the CIC website. These questions will determine whether you are eligible to apply online for a Canadian student permit, and what documents you’ll need to provide.

If you are found eligible, you will receive a personal checklist code, valid for 60 days, which you will need in order to submit your application online. Make sure to print out the page containing your code for future reference. The page will also include an application guide, an estimated tuition fees amount, a list of documents you will need to submit with your application, and guidelines for your next steps.

When you are ready to apply, create a MyCIC account, where you will enter your personal checklist code. You will then receive your personal document checklist which allows you to upload and send your documents to CIC. You’ll need a printer or a scanner to do this.

Once you have your documents and application form ready and have paid your fees, you can submit your completed application to CIC.

Some applicants may have to attend an interview at their local visa office.
Additional Canadian student visa requirements
Some or all of the following additional Canadian student visa requirements may also apply:

Applicants from Europe, the Middle East or Africa may need to provide biometrics (photograph and fingerprints).
Some applicants may also need to get a medical exam and/or police check before submitting their application. You will not be able to get a study permit if you have a criminal record – you may be asked to provide a Police Clearance Certificate as proof.
Unless you’re from the US or St. Pierre and Miquelon, you will need to prove you have a valid passport which allows you to return to your country of origin after your course is complete. Two passport-sized pictures are also required, with your name and date of birth written on the back.
Canadian student visa requirements also include proof of funds to support yourself. At present this is deemed to be CA$10,000 (~US$7,650) for every year of your stay (CA$11,000/~US$8,400 if you’re applying to study in Quebec) on top of your tuition fees. You will also need to make sure you have enough money to pay for transportation to return home.
To prove you have this money, you can provide any of the following documents: bank statements, evidence of a Canadian account in your name if the money’s been transferred, a bank draft in a convertible currency, proof of payment of tuition and accommodation fees, a letter from a person or institution providing you with money, or proof of funding paid from within Canada if you have a scholarship or are undertaking a Canadian-funded program.

Applying through the Student Direct Stream
Canada recently introduced the Student Direct Stream, which students from China, India, the Philippines or Vietnam can apply for in order to get their study permit faster. The requirements are similar to the regular study permit, although there are stricter language requirements – you need to have an IELTS score of at least 6, or a 7 in the Niveaux the Compétence Linguistique Canadiens for French, or have graduated from a Canadian-curriculum high school. If you don’t meet the requirements for the Student Direct Stream but do meet them for the regular study permit, your application will be reviewed for the regular study permit option and you won’t get faster processing.

Next steps after applying
If and when your Canadian student visa application is approved, you’ll receive a Port of Entry (POE) Letter of Introduction, while students from countries which require an Electronic Travel Authorization (eTA) and/or a temporary residence visa will be issued these if required. The eTA will be linked to your passport. It is important that you travel with the passport you used when you applied for your study permit. The eTA will be valid for five years or until your passport expires, whichever comes first.

Present these along with your passport, proof of your finances and your letter of acceptance (and any other documents that you’ve been advised to take) to the Canada Border Services Agency (CBSA) in Canada, who will then issue your Canadian study permit and allow you access into Canada.

Working while you study in Canada
If you’d like to get a part-time job to help support yourself while studying in Canada, you can now qualify to work on or off-campus for up to 20 hours during university semesters and full-time during breaks such as the winter or summer holidays, without the need for a work permit.

To qualify, you must:

Have a valid study permit
Be a full-time student
Be enrolled at a designated learning institution at post-secondary level or, in Quebec, a vocational program at secondary level
Be studying in an academic, vocational or professional training program that leads to a degree, diploma or certificate that is at least six months in duration.
You will also need a Social Insurance Number (SIN) from Service Canada to work in Canada or to receive benefits and services from government programs.

Your study permit will become invalid 90 days after you have completed your study program, so you’ll need to acquire a post-graduation work permit if you want to stay in Canada after your studies and seek work. How to Get a UK Student Visa
UK visa requirements and general immigration criteria are managed by UK Visas and Immigration, which has an easy-to-navigate site to help you determine whether you need a UK student visa. While Swiss nationals and those from the EU/EEA states do not currently need a visa to study in the UK, all other international students are likely to need one.

The result of the UK’s referendum on membership in the European Union (‘Brexit’) has led to some uncertainty over visa regulations, but the UK government has stated that there will be no change to the rights and status of EU citizens until 2021.
Types of UK student visa
If you’re studying a short course and are over 18 years old, you may be eligible for the short-term study visa. This is valid up to six months for most short courses and can be extended for a stay of up to 11 months for English language courses.

If you’re studying a longer course, you’ll need to make sure your chosen institution holds a Tier 4 Sponsor License. You can either apply for a Tier 4 (Child) student visa (if you’re aged 4-17 and want to study at an independent school in the UK) or a Tier 4 (General) student visa for those aged 16 and over.

UK student visa requirements
Your course provider may be willing to help you to apply for a UK student visa once you have been offered a place on a course; ask to find out if this is the case. You can apply for the visa up to three months in advance of the start date of your course. Check the average visa processing times for your country, and be sure to allow plenty of time.

UK student visas are awarded on a points-based system. In order to meet all the UK student visa requirements, you’ll need to provide:

Details of your passport
A recent photograph
An unconditional offer of a place on a course offered by a licensed Tier 4 Sponsor, evidenced by a 'Confirmation of Acceptance for Studies’ (CAS) form from your course provider (worth 30 points)
Proof of adequate English language skills, demonstrated by passing one of the secure English language tests (SELT). You will not need to provide this if you’re from an English-speaking country such as the United States or have completed a qualification equivalent to a UK degree in an English-speaking country.
Proof you have financial support throughout your stay in the UK (worth 10 points)
If you’re a non-EU/EEA/Swiss student studying a sensitive subject, you may also need an ATAS certificate
Proof of financial support can take the form of bank statements or a letter from your financial sponsor, showing you can cover your tuition fees, accommodation and living costs. You must prove that you have £1,015 (~US$1,300) per month for living costs if studying in the UK outside of London, and £1,265 (~US$1,600) a month for living costs if studying in London.

You may also be required to produce documents showing your academic qualifications, and to attend an interview or biometric test, which includes a digital scan of your fingerprints. Depending on your country of origin, you may also be required to have certain medical vaccinations or undertake a tuberculosis test.

If you’re 16 or 17 years old and applying for the Tier 4 (General) student visa, you must have written consent from your parents/guardians that you can live and travel independently.

You must apply online for the Tier 4 (General) Student visa, ensuring you’ve read the full guidance here. You can apply up to three months before the start of your course.

UK student visa fees
The current fee for the Tier 4 (General) student visa is £348 (~US$440), with an additional £348 fee per person for any dependents. You’ll also need to pay a healthcare surcharge of £150 per year (~US$190) in order to access the National Health Service (NHS) during your stay (this will rise to £300 (~US$380) from late 2018).

The Short Term Study Visa costs £97 (~US$120) for the six month option and £186 (~US$240) for the 11 month visa.

Streamlined visa processes for master’s students at 27 universities
You can now apply for streamlined visa processing to study a master’s degree at one of the 27 eligible universities (listed here), as part of a new Tier 4 Pilot scheme. Your course will need to be 13 months or less and you can apply from inside or outside the UK. The pilot scheme allows you to stay longer after the end of your course (you can stay for six months after you’ve finished your studies) and also means that you won’t need to submit documents showing your academic results or proof of funds. However, you will still need to have these documents to hand in case they are needed, and will still need to follow all the other immigration guidelines.

Using your UK student visa
When you enter the UK, a UK Border Agency officer will put a stamp on your passport that states the duration of your stay in the UK. For example, if your course is 12 months or more, you can stay for the full duration of the course plus an additional four months. You cannot extend your stay beyond this period.

Before you arrive, you must make sure you are fully immunized, remembering to pack your immunization record in your hand luggage in case you are asked to show the Border Agency officer at your UK port of entry. You should also carry the documents relating to your studies (including your Confirmation of Acceptance for Studies or CAS number), your proof of finances and your proof of accommodation.

Depending on where you’re from, you may also be required to register with the police within seven days of arrival in the UK.

Working while studying in the UK
All EU, EEA and Swiss students can work while studying in the UK. Students of publicly funded higher education institutions on Tier 4 student visas can work for up to 20 hours per week during term time and full-time during Christmas and Easter breaks (unless you are aged 16 or 17, in which case the maximum is 10 hours per week during term time).
