Ambreen Akram v. Asad Ullah Khan & others
Held: The Supreme Court ruled that a Muslim wife's right to maintenance (nafaqah) arises from the solemnization of a valid Nikah and is not dependent upon rukhsati or consummation of marriage.

Key points:

Valid Nikah creates the husband's obligation to maintain his wife.

Non-consummation alone is not a ground to deny maintenance.

Rukhsati does not postpone the wife's legal entitlement.

If the husband alleges that the wife unjustifiably refused to live with him, the burden is on the husband to prove it.

Ratio: Maintenance is ordinarily payable from the date of valid marriage, irrespective of whether rukhsati or consummation has occurred.

Short Overview:

🎓Where an agreement to sell fixes a definite date for payment of the balance consideration, the purchaser must establish continuous readiness and willingness and cannot rely merely on a verbal assertion. Failure to tender the balance within the stipulated time, coupled with absence of contemporaneous evidence of funds, may defeat specific performance.

2026 SCMR 994 - Overview
Mst. Safia Khanum & others v. Additional District Judge-II East, Islamabad & others, decided on 7 January 2026.

The Supreme Court held that:

A third/fresh suit on the same cause of action is barred where an earlier suit was withdrawn/dismissed and no permission to file a fresh suit was obtained under Order XXIII Rule 1 CPC.

A party cannot abandon one legal remedy/forum and subsequently pursue another for the same cause of action; this attracts the doctrine of election.

Order II Rule 2 CPC, read with Article 114 Qanun-e-Shahadat Order, 1984, can bar such subsequent proceedings.

In the circumstances, the Supreme Court refused leave to appeal and dismissed the petition.
