یکم جولائی 2026 سے تمام متعلقہ ٹرانزیکشنز پر 8% PRA سیلز ٹیکس وصول کریں۔

لاہور ہائی کورٹ نے اہم فیصلہ دیتے ہوئے واضح کیا ہے کہ قریبی رشتہ داروں (والدین، اولاد، میاں بیوی وغیرہ) کے درمیان دیا گیا گفٹ اگر بینکنگ چینل کے بغیر بھی ہو، تو اسے خود بخود ٹیکس ایبل Income نہیں سمجھا جا سکتا۔ محکمہ کا مؤقف یہ تھا کہ قانون کے مطابق غیر بینکنگ گفٹ لازماً “Income from Other Sources” بنتا ہے، مگر عدالت نے یہ مؤقف مسترد کر دیا۔

عدالت نے قرار دیا کہ فنانس ایکٹ 2019 کے ذریعے شامل کی گئی دفعہ 39(1)(la) ایک فائدہ مند اور طریقہ کار سے متعلق ترمیم ہے، اس لیے یہ ماضی کے سالوں پر بھی لاگو ہوگی۔ اس کا مطلب یہ ہے کہ رشتہ داروں سے ملنے والے تحائف کا سختی سے بینک چینل سے گزرنا ضروری نہیں، بلکہ ٹیکس دہندہ کو حق حاصل ہے کہ وہ ثبوت اور وضاحت کے ذریعے یہ ثابت کرے کہ رقم واقعی تحفہ تھی۔
