A lady asked me that she could seek maintenance of her children from her husband if she get khulla from a court?.

Yes! after getting khulla from court , she can still file family suit against father of children for their maintenance for their upbringing.

Since the maintenance is their right! 🤝🏻👨‍👩‍👧‍👦🏛️💼

ایک خاتون نے مجھ سے پوچھا کہ کیا وہ عدالت سے خلع لینے کے بعد اپنے بچوں کے لیے اپنے شوہر سے خرچ (نفقہ) کا مطالبہ کر سکتی ہے؟
جی ہاں! عدالت سے خلع حاصل کرنے کے بعد بھی وہ اپنے بچوں کی پرورش کے لیے ان کے والد کے خلاف نان و نفقہ کا دعویٰ دائر کر سکتی ہے۔
کیونکہ نان و نفقہ بچوں کا بنیادی حق ہے! .

What to do if tenant neither pay rent nor surrender rented house ?

If tenant does not pay rent , nor surrender rented house. In such circumstances don't take law into hands but file "Eviction Petition " before rent controller's court against tenant!

In a legal way , land lord can evict his rented house from tenant !

اگر کرایہ دار نہ کرایہ ادا کرے اور نہ ہی کرایہ شدہ مکان خالی کرے تو ایسی صورت میں خود سے کوئی غیر قانونی قدم نہ اٹھائیں بلکہ قانونی راستہ اختیار کریں۔
ایسی صورتحال میں مالک مکان کو چاہیے کہ وہ کرایہ دار کے خلاف کرایہ کنٹرولر کی عدالت میں "بیدخلی کی درخواست" (Eviction Petition) دائر کرے۔
قانونی طریقے سے مالک مکان اپنے کرایہ دار کو مکان سے بے دخل کروا سکتا ہے۔

What is remedy to landlord if a Tenant neither pay rent nor surrender his rented property?

If landlord has:

1. Tenancy agreement.
2. Rent receipts.
3. Other evidence i. e having Title.

Then: landlord have legal remedy to file "Eviction Petition before rent controller of the jurisdiction under section 15 & 16 of Sindh Rented Premises Ordinance 1979 for the recovery of rent and eviction of tenant from the rented premises of landlord.
اگر کرایہ دار نہ تو کرایہ ادا کرے اور نہ ہی کرایہ شدہ جائیداد خالی کرے تو مالک مکان کے پاس درج ذیل قانونی چارہ جوئی موجود ہے:
اگر مالک مکان کے پاس:
کرایہ نامہ (Tenancy Agreement)
کرایہ کی رسیدیں (Rent Receipts)
دیگر ثبوت مثلاً ملکیت کے کاغذات (Title Documents)
موجود ہوں، تو مالک مکان مجاز ہے کہ وہ متعلقہ اختیار رکھنے والے رینٹ کنٹرولر کے سامنے سندھ رینٹڈ پریمیسز آرڈیننس 1979 کی دفعات 15 اور 16 کے تحت دعویٰ برائے تخلیہ و وصولی بقایا کرایہ دائر کرے۔
