Another Milestone Achieved by Our Legal Team.
By the grace of Allah, our legal team has successfully secured dismissal of a Rs. 5 Crore defamation suit filed against our client.
Brief Background:
The plaintiff instituted a suit for defamation, claiming damages of Rs. 5,00,00,000 (Five Crores), alleging that statements made by our client during a pending civil proceeding damaged his reputation, caused mental anguish, and resulted in financial loss.
Our Legal Strategy:
On behalf of our client, we appeared before the Honorable V-Additional District & Sessions Judge, Karachi East, and filed a Written Statement along with an application under Order VII Rule 11 CPC for rejection of the plaint.
Key Arguments:
Statements made during judicial proceedings are protected as qualified privileged; therefore, no defamation action lies.
There was no publication, dissemination, or circulation of any alleged defamatory material to the public.
The suit was barred by law, including Sections 8 and 12 of the Defamation Ordinance.
Hence, the suit was not maintainable.
Outcome:
After detailed arguments, the Honorable Court allowed our application VII Rule 11 and rejected the plaint, holding the suit to be not maintainable.
