I took on the task of representing a divorced lady and her two unmarried and minor daughters in a maintenance case. Her husband divorced her at the age of approximately 53 years to prevent them from receiving financial and inheritance.
Allhamdulilah, the Honorable court decided in favour of my clients and directed the father to provide interim monthly maintenance as Rs.50000/- per month for two minor daughters.

A person in possession of immovable property has the right to retain possession. They cannot be dispossessed until someone with a superior claim, through inheritance or transfer, legally challenges their possession.

جس شخص کے قبضے میں غیر منقولہ جائیداد ہو، اسے قبضہ برقرار رکھنے کا حق حاصل ہوتا ہے۔ اس سے قبضہ اس وقت تک نہیں لیا جا سکتا جب تک کہ کوئی ایسا شخص، جو وراثت یا قانونی منتقلی کے ذریعے بہتر حق رکھتا ہو، قانونی طور پر اسے چیلنج نہ کرے۔

اقبالِ جرم کسی بھی مقدمے میں ایک انتہائی اہم قانونی پہلو ہوتا ہے۔ قانون کے مطابق، اگر کوئی ملزم اپنے جرم کا اعتراف کرتا ہے، تو اس کا بیان اسی کے الفاظ میں ریکارڈ ہونا چاہیے تاکہ کسی بھی قسم کی غلط بیانی یا زبردستی کا امکان نہ رہے۔ عدالتیں ہمیشہ یہ دیکھتی ہیں کہ اعترافی بیان رضا مندی سے دیا گیا ہو اور اس میں کوئی جبر شامل نہ ہو۔ 2001 MLD 807 کے مطابق، اگر ملزم کے الفاظ میں ہی اقبالِ جرم درج نہ کیا جائے تو اسے ثبوت کے طور پر قبول نہیں کیا جا سکتا۔

Confession of a crime is a crucial legal aspect in any case. According to the law, if an accused confesses to a crime, their statement must be recorded in their own words to ensure authenticity and prevent any misrepresentation or coercion. Courts always verify that the confession was made voluntarily without any undue pressure. As per the legal precedent set in 2001 MLD 807, if the confession is not recorded in the exact words of the accused, it may not be considered valid evidence.
