Attended one day Training Session which was conducted on "Women & Child Abuse and Trafficking" vide dated 28-11-2024 at Police School of Investigations, Garden Karachi Range.
Wherein, I recieved certificate for participation from the very humble and most Senior Journalist Salahuddin Sb, however Barrister Aashir Masood SB, Director I.B, V.C Ilma University and others were present in the seminar.
As a lawyer, let me introduce you with an existing law pertains to the Human Trafficking named as "Prevention of Trafficking In Person Act, 2018" (hereinafter referred as Act). This Act was promulgated on 2 June, 2018, it especially deals with children and women trafficking.
Moreover, Section 3 of this Act defines the trafficking in persons, and it says that any person who recruits, harbours, transports, provides or obtains another person, or attempts to do so, for compelled labour or commercial s*x acts through the use of force, fraud or coercion, commits an offence of trafficking in persons, such person shall be punished with imprisonment which may extend to seven years or with fine which may extend to one million rupees or with both.
Under this Act, victim shall not be liable for the offence committed under this Act, just because such offences are not being committed with his consent, there would be a beneficiary who get such crimes committed by the victim.
Let's suppose, "A" compels, forces or threats "B" for begging in the street, and the "B" is begging without his consent due to fear of "A" so the ultimate beneficiary is "A". Meaning thereby, "A" will be criminally liable for the offence being committed by "B", neither "B" commits such crime with his consent nor "B" is the beneficiary, even though "B" could become witness in such cases.
Nevertheless, offences committed under this Act shall be cognizable and non-bailable .
The definition quoted above is not the literal definition mentioned in the Act, however I have tried to simplify it so that the people could understand it.
Lastly, the most important question pertains to the JURISDICTION as to which law enforcement agency will deal such cases and who has the jurisdiction under this Act.
Under this Act, it is stated that if the crime is committed within the territorial jurisdiction of Pakistan, then local Police will have the jurisdiction of such offence and if the crime under this Act is committed beyond the territorial jurisdiction of Pakistan, since then the Federal Investigation Agency known as FIA will have the jurisdiction of such crime.
