In this matter, the father had filed a petition for permanent custody under the Guardians and Wards Act, 1890 for two minor children aged approximately three years and 1.2 years, despite the fact that he had himself forced the mother and the children to leave the matrimonial home. Our client, the mother, approached the court seeking justice and protection for her children, including claims for maintenance, recovery of dowry articles, payment of dower (Haq Mehr), and other lawful entitlements. During the proceedings, our team also highlighted before the Hon’ble Court that one of the minors is autistic and requires special care, therapy, and medical attention, making the child’s welfare and financial needs even more significant.

Through persistent representation, detailed arguments, and careful presentation of facts, K&M Legal Services successfully defended the custody claim and secured comprehensive relief for our client. The Hon’ble Family Court dismissed the father’s petition for permanent custody and held that the welfare of the minors lies with their mother. The court further decreed in favor of our client by granting payment of dower amount, recovery of dowry articles, iddat maintenance, past maintenance, and future maintenance with annual increments for the minors, particularly considering the special needs of the autistic child. This judgment ensured both the protection of the minors’ welfare and the enforcement of our client’s lawful rights after nearly two years of litigation.
