COMPROMISE IN CRIMINAL CASES: KEY LEGAL PRINCIPLES AND JUDICIAL PRECEDENTS UNDER PAKISTANI LAW

Compromise (Razinama) occupies an important place in Pakistan's criminal justice system. However, not every offence is legally capable of being compromised. Section 345 of the Code of Criminal Procedure, 1898 (Cr.P.C.) specifically identifies offences that are compoundable and those that are non-compoundable.

1. Compoundable Offences

In compoundable offences, the aggrieved person or the legal heirs of the victim may lawfully forgive the offender, and the Court, upon being satisfied regarding the genuineness and legality of the compromise, may approve the same.

Legal Principle

A lawful compromise in compoundable offences may be accepted at any stage of the proceedings, including trial, appeal, and even after conviction, subject to the permission of the Court where required by law.

Notable Judicial Precedents

• Shabbir Ahmed v. The State (NLR 1992 CrLJ 320)
• Muhammad Anar v. The State (1995 MLD 1503)
• Ibrahim v. The State (1995 SCMR 1296)
• Sharafat Ali v. The State (1997 PCrLJ 99)
• Nisar Ahmed v. The State (1988 PCrLJ 1449)
• Ali Raza @ Kalo v. The State (NLR 2007 CrLJ 392)

These cases reaffirm that a valid compromise can result in acquittal or release of the accused in offences recognized by law as compoundable.

2. Non-Compoundable Offences

Offences not included within the ambit of Section 345 Cr.P.C. are non-compoundable. In such cases, a private settlement between the parties does not automatically result in acquittal.

(a) Compromise as a Ground for Mitigation of Sentence

Although compromise cannot extinguish criminal liability in non-compoundable offences, courts may consider it as a mitigating factor while determining sentence.

Relevant Case Law

• Ghulam Farid v. The State (PLD 2006 SC 53)
• Nazir Ahmad v. The State (2007 PCrLJ 185)
• Hafiz Muhammad Aslam v. The State (2006 MLD 1288)
• Ghulam Rasool v. The State (NLR 1998 SD 682)
• 2002 SCMR 1885

Principle

A compromise in a non-compoundable offence may justify leniency or reduction in sentence, but it does not ordinarily lead to acquittal.

(b) Rejection of Compromise in Serious Offences

The superior courts have consistently held that certain offences are not merely private wrongs but offences against society and the State.

Relevant Authorities

• PLD 2005 Lahore 328
• PLD 2003 SC 389
• 2004 SCMR 1170
• 2005 SCMR 1162
• 2007 PCrLJ 1433

Principle

Compromise cannot be used as a basis for terminating proceedings or acquitting an accused in serious offences such as terrorism, kidnapping for ransom, dacoity, and crimes affecting public peace, security, and societal order.

3. Effect of Compromise in Bail Matters

Even where an offence is non-compoundable, a compromise may remain a relevant consideration in bail proceedings.

Relevant Judgments

• 2008 MLD 991
• 2008 MLD 1079

Principle

A compromise does not create an automatic right to bail; however, it may be considered by the Court as one of the relevant factors while exercising its judicial discretion.

4. Impact of Section 311 PPC

In certain murder cases, even where the legal heirs of the deceased have forgiven the offender or entered into a compromise, the Court may still impose punishment under Section 311 of the Pakistan Penal Code.

Principle

Where the Court finds that the offence amounts to Fasad-fil-Arz or has adversely affected public order, societal peace, or the public interest, punishment may be maintained notwithstanding the compromise between the parties.

Conclusion

Under Pakistani criminal law, the doctrine of compromise is confined to those offences expressly declared compoundable by law. In non-compoundable offences, compromise generally does not result in acquittal, although it may be considered for mitigation of sentence or as a relevant factor in bail matters. Courts determine the legal effect of a compromise in light of Section 345 Cr.P.C., Section 311 PPC, public policy considerations, the interests of justice, and the broader impact of the offence upon society.

(Compoundable Offences).........

Shabbir Ahmed v. The State (NLR 1992 CrLJ 320)
Muhammad Anar v. The State (1995 MLD 1503)
Ibrahim v. The State (1995 SCMR 1296)
Sharafat Ali v. The State (1997 PCrLJ 99)
Nisar Ahmed v. The State (1988 PCrLJ 1449)
Ali Raza @ Kalo v. The State (NLR 2007 CrLJ 392)
(Non-Compoundable Offences)........

Ghulam Farid v. The State (PLD 2006 SC 53)
Nazir Ahmad v. The State (2007 PCrLJ 185)
Hafiz Muhammad Aslam v. The State (2006 MLD 1288)
Ghulam Rasool v. The State (NLR 1998 SD 682)
2002 SCMR 1885
PLD 2005 Lahore 328
PLD 2003 SC 389
2004 SCMR 1170
2005 SCMR 1162
2007 PCrLJ 1433

Legal Insight | Section 489-F PPC

The law is well settled that the mere issuance or possession of a cheque does not automatically attract the provisions of Section 489-F of the Pakistan Penal Code. For criminal liability to arise under this section, it must be established that the cheque was issued towards the discharge of a legally enforceable debt, financial obligation, or liability.

Where the prosecution fails to demonstrate the existence of such an obligation, the matter may not fall within the scope of Section 489-F PPC.

Reaffirming this principle, the Supreme Court of Pakistan, in 2024 SCMR 1567, confirmed the grant of pre-arrest bail to the accused, emphasizing that the existence of a legally recoverable debt or obligation is an essential ingredient of the offence.
