مگر حیرت انگیز طور پر:
نہ کسی ماتحت عدالت نےنہ ہائی کورٹ یا سپریم کورٹ نے
نہ کسی وکیل نےاور نہ ہی کسی عدالتی فیصلے میں
یہ نشاندہی کی گئی کہ آرٹیکل 113 میں استعمال ہونے والے الفاظ “rule or pleading” کسی قانونی یا عملی غلطی پر مشتمل ہیں۔
اگے اب، 41 سال بعد یہ احساس ہوا کہ
“or”
نہیں بلکہ “
of”
ہونا چاہیے

کامن لا – تفصیلی وضاحت (اردو)

کامن لا کیا ہے؟
کامن لا قانون کا وہ نظام ہے جو بنیادی طور پر عدالتوں کے فیصلوں سے تشکیل پاتا ہے۔ اس نظام میں جج حضرات قانون کی تشریح کرتے ہیں اور ان کے فیصلے آئندہ مقدمات کے لیے مثال (Precedent) بن جاتے ہیں۔ اس اصول کو اسٹیرے ڈیسائسز کہا جاتا ہے، یعنی سابقہ فیصلوں کی پیروی۔

کامن لا کا تاریخی ارتقاء:
کامن لا کی ابتدا 1066ء کے بعد انگلینڈ میں ہوئی۔ اس سے پہلے مختلف علاقوں میں مختلف رواجی قوانین رائج تھے۔ بارہویں صدی میں بادشاہ ہنری دوم نے شاہی جج مقرر کیے جو ملک کے مختلف حصوں میں جا کر مقدمات کا فیصلہ کرتے تھے۔ ان فیصلوں کو تحریری شکل دی گئی اور بعد میں انہی فیصلوں کی پیروی کی جانے لگی۔ یوں ایک مشترکہ قانونی نظام وجود میں آیا جسے کامن لا کہا گیا۔

برطانوی سلطنت کے پھیلاؤ کے ساتھ یہ نظام پاکستان، بھارت، امریکہ، کینیڈا اور آسٹریلیا سمیت کئی ممالک میں رائج ہوا۔ پاکستان میں بھی کامن لا نظام نافذ ہے اور عدالتیں اکثر سابقہ عدالتی فیصلوں سے رہنمائی لیتی ہیں۔

کامن لا کی اہم خصوصیات:

- عدالتی فیصلوں پر مبنی نظام

- سابقہ فیصلوں کی پابندی

- وقت کے ساتھ قانون کی ترقی

- تحریری قوانین کے ساتھ ہم آہنگی

کامن لا کی اہمیت:
کامن لا انصاف میں یکسانیت، استحکام اور لچک فراہم کرتا ہے۔ یہ تحریری قانون کی خامیوں کو پورا کرتا ہے اور معاشرتی ضروریات کے مطابق قانون کو ترقی دیتا ہے۔

COMMON LAW – Detailed Explanation (English)

What is Common Law?
Common Law is a legal system developed through the decisions of courts rather than through written statutes alone. In this system, judges play an important role by interpreting the law and their decisions become binding precedents for future cases. This principle is known as stare decisis , meaning “to stand by decided cases.”

Historical Evolution of Common Law:
Common Law originated in England after the Norman Conquest of 1066. Before this period, local customs governed different regions. King Henry II (12th century) played a key role in developing a unified legal system by sending royal judges across England. These judges decided cases, and their judgments were recorded and followed in similar cases later. Over time, these consistent decisions formed a common body of law, hence the name Common Law.

As the British Empire expanded, Common Law spread to many countries including Pakistan, India, the United States, Canada, and Australia. In Pakistan, Common Law operates alongside statutory law, and courts frequently rely on precedents.

Key Features of Common Law:

- Based on judicial decisions and precedents

- Flexible and evolves with time

- Emphasizes reasoning and interpretation by judges

- Works together with written laws (statutes)

Importance of Common Law:
Common Law ensures consistency, predictability, and fairness in judicial decisions. It helps in filling gaps where written law is silent and adapts law according to changing social needs.
