LAHORE HIGH COURT

Crl. Misc. No. 43416-B of 2026

Ali Shahzad alias Shan Ali Versus The State etc.

Seeking Post Arrest Bail under Sections 324, 148 and 149, PPC, 1860

1️⃣ Facts:
The Complainant has alleged that the Petitioner, while armed with a pistol, fired at Farooq Ahmad, son of the complainant, which allegedly struck the latter on the left side of his chest.

2️⃣ Findings / Observations of Court:
The charge was framed almost one year after the petitioner's arrest, whereas the substantial period preceding the framing of charge has neither
been explained by the prosecution nor attributed, through any specific act or omission, to the petition. On several dates, the complete prosecution evidence was not available and
adjournments were sought from the complainant/prosecution side for producing the complete evidence.

3️⃣Decision
The petition allowed and pettioner admitted to post-arrest bail as;
In the present case, the delay in submission of the challan is attributable to the prosecution. No material has been brought on record showing that the petitioner caused or contributed to that delay.
Pre-trial detention cannot be permitted to assume the character of punishment, particularly
where the accused has remained incarcerated beyond the statutory period and the trial is not likely to conclude in the immediate future.

FEDERAL CONSTITUTIONAL COURT OF PAKISTAN

C.P.L.A. No. 1836-L of 2019

EQUIVALENCE CERTIFICATE - HIGHER EDUCATION COMMISSION

1️⃣ Facts:

The controversy, in essence, concerns the petitioner’s claim for admission to the M.Phil Programme offered by the University. His application was declined by the University on the ground that the MBA degree obtained by him comprised of 20 courses carrying a total of 60 credit hours, whereas, according to the University, its own MBA programme comprised of 25 courses carrying 75 credit hours

2️⃣ Reasons:
the grievance of the petitioner does not disclose any jurisdictional error or other legal infirmity warranting interference with the judgment of the learned High Court.
The learned High Court, while allowing the University’s ICA, was justified in recognizing the distinction between the Commission’s authority to determine equivalence and the University’s independent authority to prescribe and enforce eligibility requirements for admission to its academic programmes.

3️⃣Decision
The W.P was dismissed as;
The impugned judgment of the learned High Court is well-reasoned, comprehensive and legally sustainable. Upon a careful appraisal of the record and the reasons recorded therein, we find that the learned High Court properly appreciated the material facts on record and correctly applied the governing principles of law.

3️⃣Decision
The appeal was dismissed as;

In the overall circumstances of the case, it prima facie seems to me that the case is based on a fake and manufactured instrument and false evidence was tendered in Court based on the said agreement.

The failure of the Appellant to produce the notary public named in the Agreement , the payments he made against purchase of land, signatures in the Agreement attributed to the Respondent No. 1 are not tallying with each other.
