SSR & Co. successfully represented the National Highway Authority (NHA) in M/s Shan Enterprises v. NHA & others, securing the vacation of the interim injunction and dismissal of the plaintiff’s application under Order ###IX Rules 1 and 2, CPC.

Mr. Mudassir IQbal Khan, Senior Associate at the Firm successfully argued that mere participation in a public procurement process or, even claiming to be the highest bidder, does not create any vested or indefeasible right to the award of a contract. The plaintiff had neither exhausted the statutory remedy available under the applicable procurement framework nor established the existence of any concluded contract in its favour.

The learned Court held that the plaintiff had failed to establish a prima facie case, balance of convenience, or irreparable loss. The Court further recognised that restraining an ongoing procurement process concerning the operation and management of public toll plazas would adversely affect public interest and the functioning of a statutory authority.

We commend Mudassir Iqbal for his diligent preparation and compelling legal submissions in securing this favourable outcome for NHA.

SSR & Co., Advocates & Legal Consultants, successfully represented the National Highway Authority (NHA) in a civil dispute concerning the operation, management and collection of toll revenue under a public procurement contract.

Mr. Saad Javid Satti, Managing Partner of SSR & Co., argued the matter on behalf of NHA and successfully secured the vacation of the ad-interim injunction restraining NHA from encashing the financial guarantees and bid security submitted by the plaintiff.

The learned Court held that the plaintiff had failed to establish a prima facie case, that the balance of convenience did not lie in its favour, and that any alleged loss was ascertainable in monetary terms and therefore did not constitute irreparable loss. Consequently, the application for temporary injunction under Order ###IX Rules 1 and 2 of the Code of Civil Procedure, 1908, was dismissed.

As a result, NHA may now proceed with the encashment of the financial guarantees and take all consequential measures arising from the termination of the contract, in accordance with the applicable contractual and legal framework.
