یہ فیصلہ Section 12(2) CPC (دھوکہ دہی، جعلسازی یا بدنیتی سے حاصل کیے گئے فیصلے کو چیلنج کرنے کی درخواست) کے بارے میں ہے۔

⚖️ کیس کا پس منظر
ٹرائل کورٹ نے ایک Ex-parte decree (یکطرفہ ڈگری) جاری کیا۔
مخالف فریق نے S.12(2) CPC کے تحت درخواست دائر کی، کہ فیصلہ فراڈ، ملی بھگت اور غلط بیانی پر مبنی ہے۔
ٹرائل کورٹ نے درخواست کو بغیر شواہد ریکارڈ کیے اور بغیر Issues فریم کیے Summarily (خلاصہ وار) مسترد کر دیا۔
ریویژنل کورٹ نے بھی مداخلت نہیں کی۔
لاہور ہائی کورٹ نے کہا کہ یہ غلطی ہے اور معاملہ دوبارہ ٹرائل کورٹ کو بھیج دیا تاکہ وہ باقاعدہ Issues فریم کرے، گواہوں کو سن لے اور پھر فیصلہ کرے۔

📌 عدالتی مشاہدات (Court’s Observations)
1. Procedural Defect in Ex-parte Decree
ٹرائل کورٹ نے تسلیم کیا کہ Ex-parte ڈگری میں طریقہ کار کی کمی تھی، لیکن خود بھی درست طریقہ اختیار نہیں کیا۔
2. Serious Allegations of Fraud & Collusion
جب دھوکہ دہی، جعلسازی اور ملی بھگت جیسے سنگین الزامات ہوں تو کیس کو صرف کاغذی کارروائی کی بنیاد پر نہیں نمٹایا جا سکتا۔
3. Need for Proper Trial
Issues فریم کرنے اور شہادت ریکارڈ کرنے کی ضرورت ہے تاکہ دونوں فریقین کو مکمل موقع ملے۔
4. Judicial Integrity
اگر عدالت Summarily درخواست مسترد کرے اور شواہد نہ لے تو یہ انصاف کے عمل کی شفافیت کو متاثر کرتا ہے۔
5. Remand to Trial Court
عدالت نے کیس واپس ٹرائل کورٹ کو بھیج دیا کہ وہ تمام ضروری فریقین کو شامل کرے، Issues فریم کرے، شواہد ریکارڈ کرے اور قانون کے مطابق فیصلہ دے۔

📖 عدالتی اصول (Legal Principles)
1. Ex-parte decree اگر Fraud یا Misrepresentation پر مبنی ہو تو S.12(2) CPC کے تحت Challenge ہو سکتا ہے۔
2. Summary disposal صرف تب ممکن ہے جب کیس بالکل واضح ہو؛ دھوکہ دہی کے سنگین الزامات پر لازمی ہے کہ Evidence لی جائے۔
3. Issues framing اور Evidence recording لازمی ہیں تاکہ Natural Justice کے تقاضے پورے ہوں۔
4. Procedural lapses (طریقہ کار کی خلاف ورزی) خود بخود عدالت کے فیصلے کو مشکوک بنا دیتے ہیں۔
5. High Court under Article 199 Constitution مداخلت کر سکتی ہے اگر نچلی عدالت Procedural Fairness کی خلاف ورزی کرے۔

----S. 12(2)---Constitution of Pakistan, Art. 199----Ex-parte decree, setting aside of---Serious allegations of fraud, collusion and misrepresentation---Procedural defect, identification of---Non-framing of issues---Summary disposal of application under S. 12(2) C.P.C. by the Trial Court and non-interference by the revisional court---Held, that Trial Court correctly identified the procedural defect in the ex-parte judgment and decree, but failed to adopt the proper procedure while deciding the application under S.12(2) C.P.C.---Respondents had disclosed serious allegations of fraud, collusion and misrepresentation culminating in the said judgment and decree, thus, summary disposal of the application was not justified---Trial Court should have framed necessary issues and record evidence of the parties, particularly as the ex-parte judgment and decree had also been passed without recording evidence and such a procedural lapse undermined the integrity of the judicial process and warranted a more detailed inquiry---Trial Court erred in law by summarily disposing of the application under S.12(2) C.P.C., as the allegations raised by the respondents required adherence to procedural requirements to ensure a just and fair adjudication---Constitutional petition was allowed, in circumstances and the matter was remanded to the Trial Court with a direction to allow the relevant parties to become a necessary part, frame proper issues, allow them to lead evidence and then decide the application under S. 12(2), C.P.C. afresh in accordance with law.
