Adoption in Pakistan isn’t as simple as it seems — because legally, “adoption” as understood in Western countries does not exist in the same way under Pakistani law.
In Pakistan, child care and guardianship are primarily governed by the Guardians and Wards Act 1890. Instead of full legal adoption that changes a child’s lineage, the law allows guardianship (kafala). This means:
• The child keeps their biological identity and family name
• Inheritance is not automatic (it must be arranged through a will)
• The guardian is legally responsible for care, education, and welfare
Under Islamic principles followed in Pakistan, preserving a child’s lineage is very important. That’s why legal adoption (changing surname and biological identity) is not permitted in the traditional sense.
However, Islam and Pakistani law strongly encourage caring for orphans and abandoned children. The Holy Prophet (PBUH) emphasized the reward of looking after orphans.
