The Division Bench of the Lahore High Court, Lahore, comprising Mr. Justice Farooq Haider and Mr. Justice Ali Zia Bajwa, has emphatically held that no civilized society governed by the rule of law can countenance extra-judicial harm, torture, coercion, or any unlawful treatment of an accused person. The Court observed that the constitutional guarantees of human dignity, due process, and fair trial are available to every individual irrespective of the nature or gravity of the allegations against him. It was further held that law-enforcement agencies are bound to act strictly within the parameters prescribed by law, as illegal means can never be justified by the purported objective of securing a conviction. The determination of guilt is the exclusive function of a competent court of law and cannot be established through force, intimidation, coercion, or any extra-legal method. Any departure from these constitutional and legal safeguards undermines the rule of law and the administration of justice.
