LAW
(an attempt,to grasp as a layman, what law is)
When we come to make an attempt to know from where the law should seen, to be an evolving discipline, invented discipline, a created discipline. When the word didsiplinr attached we better refers to the concepts enumerated to and from, for the word discipline.
A field or a subject course line is either an art or science. By far when getting deep into the affairs we can claim law to be a scientific outcome. Say let suppose a student of science will come to an issue while deciding what quantity is a scalar quantity or what quantity is a vector quantity. With bringing in the concepts of scalars and vectors. Similarly, with Newton’s law of motion into full practise, we come to say any object in motion shall be following those laws, if it doesn’t follows any of those laws than the object is declined to be stated, as being in motion.
So any law according Salmond which is not being executable in any form, will Not be taken as law. Eventually, when solving complex mathematical sums we revert to formulae of algebra. When we summarise the algebra it lets us know the way to move in and out of equations to find the missing ( unknown) number (x), on each side or both the sides of equations. So we summarise them as laws to mathematical sums and calculations, in form to find and design complex architectural and engineering concepts.
When discussing the same matter on legal contexts, we say for any contract to be enforced or to be termed as a contract there are a few ingredients like proposal in express and implied terms, considerations, adult and sane full person in making a contract. If any condition doesn’t not exist we say that this particular term does not qualify for being a contract. Like scientifically we went to discuss about Newton’s law of motion.
When some one commits some act, we for the betterment of society, feel a need to penalise him for such an act not to be committed again. We refer to matter containd in the penal laws of a nation. And impose penalties accordingly.
Before to go on for the conclusion. We shall see why law is a subject of art. As it is among the only a few subjects which can be an art and science at the same very time. A lawyer is artist, who moulds and twists the evidence and facts in a manner that turns the tide on the favour of his respective client. Just like an architect or a civil engineer moulds the laws of science into a beautiful building like the opera house, the wonders like the Egyptian pyramids. Or a complex road and bridge networks inside a city. For the larger Benefit of the society concerned at large. Such an engineer would be considered to be an artist of scientific acumen.
A professional of law, is a scientist and an artist in the manner to whom it’s difficult for any other professional field to be in parallel to.
But a crude study of law alone without the study of similar other disciplines. Would amount to and engine running with out the mobile oil, a lamp burning without the kerosine, a wrestlers without the primary understanding of body dynamics.
As we all keep a record of previous happening in our mind to get acquaintance of dealing it when such happens again. So all such facts in field of law are recorded for us deal it in future in better civilised manner.
There fore the judge of a court shall may be such an artist to compose a judgment, in manner that strikes to hit with limited or no after effects.
