Many people are asked to secure an affidavits without fully understanding their purpose. Two commonly used documents are the Affidavit of Discrepancy and the Affidavit of Two Disinterested Persons, which apply in different situations.

An Affidavit of Discrepancy is needed when there are inconsistencies in a person’s personal records. For example, a student is applying for employment, but their birth certificate spells their name as “Mariae” while all their school records and IDs use “Maria.” To correct or explain this difference, the individual executes an Affidavit of Discrepancy to clarify that both names refer to one and the same person. This affidavit is usually supported by documents such as a birth certificate, school record/s, or valid IDs showing the inconsistency.

On the other hand, an Affidavit of Two Disinterested Persons is used when a fact needs to be established but there is no official document available to prove it. For instance, a person is applying for a government benefit and is required to prove residency in a barangay for several years, but they have no utility bills or official proof of address. In this case, two individuals who are not related to the affiant and have no personal interest in the matter may execute an affidavit confirming that the individual has indeed been residing in the area.

Both affidavits must be sworn before a notary public, and the individuals executing them must truthfully attest to the facts stated, as these documents are legally binding once notarized.

✔️ WHAT THE LAW SAYS:
Under the Civil Code of the Philippines, a contract may still exist even if it is not written. What matters is the presence of three basic elements:
• Consent (mutual agreement)
• Object (what is agreed upon)
• Cause or consideration (the reason or exchange)
Because of this, agreements made verbally can still be recognized.

In practice, some types of agreements are required to be in writing to be enforceable. Also, unwritten agreements may be harder to prove if disagreements arise.

Written agreements are often used not just for validity, but for clarity and documentation.

WHAT IF someone borrows money from you and refuses to pay?

Let's say you lent money to a friend, coworker, or even a relative. At first, they had promised to pay back the loan, but weeks or months passed, and there is still no payment. Your messages are ignored or you keep getting excuses.

What can you do?
First of all, know that even if your agreement was not supported by a loan contract in paper, it is still considered valid. You may still collect from the borrower.

Second, if the borrower still refuses to pay, you may consider sending him/her a demand letter. Sometimes, people take their obligations more seriously once legal action is involved.

Lastly, should there still be no payment after the demand letter, then there are legal remedies available to help you collect the amount, but these matters are best discussed with your lawyer.
