(1) cohabitation between two single persons is not per se immorality and is generally within the sphere of private life absent scandal/crime (Abanag); and

(2) requiring marriage for a work-related benefit is a coercive marriage condition that the Supreme Court has condemned in principle (Capin-Cadiz), and marriage-related employment qualifications must clear a high bar of justification (Capin-Cadiz; Dela Cruz-Cagampan),

therefore an agency head’s blanket requirement that cohabiting couples must marry as a prerequisite to appointment/promotion is generally improper and legally vulnerable.
