Galit ka? I-popost mo sa Facebook? Ingat, baka libel 'yan

Lahat tayo, may mga araw na gigil na gigil sa isang tao. Tipong may nakaalitan ka, nanloko sa iyo, o nakagawa ng kasalanan sa iyo na parang gusto mo nang isumbat sa buong mundo. Ang unang takbo? Bubuksan ang Facebook, magta-type ng mahabang status, o kaya nama'y ishe-share sa Group o GC ang sama ng loob.

Ang akala ng iba, kapag nasa private group o chat lang, safe na. Pero bago mo i-hit ang "Post" o "Send," i-check mo muna 'to:

Kahit totoo ang galit mo, pwede kang makasuhan: Normal lang na magreklamo kung na-offend ka o may ginawang masama sa iyo ang isang tao. Pero pagdating sa batas, ang paraan kung paano mo ilalabas ang galit mo ay pwedeng bumalik sa iyo. Kung mag-aakusa ka sa social media na ang isang tao ay nagnakaw, nanloko, o gumawa ng krimen—tapos walang basehan o court ruling pa—pwedeng tawagin itong DEFAMATION o LIBEL.

"Pero private group lang naman/GC lang 'yun, attorney": Maling paniniwala na kapag hindi nakapublish sa public wall ay lusot na. Ayon sa batas at mga desisyon ng korte, basta't nakita o nabasa ng ibang tao (kahit sa loob ng isang closed group, GC, o chat), maaring pasok pa rin ito sa PUBLICITY element ng CYBER LIBEL. Basta may nakabasa nang iba maliban sa inyong dalawa, pwedeng maging kaso.

May tamang venue para sa hustisya: Kapag may gumawa sa iyong masama, ang instinct ay "ipahiya sila para madala." Pero ang social media trial ay hindi hustisya; chismis, cyber-bullying, o cyber-libel ang tawag diyan. Kung tingin mo ay may nagawang krimen o labag sa batas ang isang tao, ang tamang hakbang ay idulog sa kinauukulan—sa pulisya, sa barangay, o sa prosecutor's office—hindi sa newsfeed.

Ang bottomline: Hindi mali ang maglabas ng sama ng loob, pero mas malaki ang magiging problema mo kapag ikaw naman ang nakasuhan dahil sa bugso ng damdamin. Mag-ingat sa bawat pag-post or pag-send dahil baka sa huli, ikaw pa ang nasa pwesto ng nasasakdal.

The (SC) has ruled that a sale of land remains valid even if the deed of sale designates a different lot number from what was actually sold, as long as the parties’ true agreement can be clearly shown. The deed may then be corrected to match what the parties actually agreed to.

In a Decision written by Associate Justice Henri Jean Paul B. Inting, the SC’s Third Division upheld the sale of a 491-square-meter parcel of land in Cebu City between buyers Genara and Felipe Abay, Sr. (the Abays) and sellers Crispin Caballes and the heirs of Trinidad Caballes-Gallardo (the Gallardos), despite the mistake in the designation of the lot number in the deed of sale.

The property formed part of the estate of Margarita Lopez, who had nine children, including Crispin and Trinidad.

The Abays visited the site with Crispin and Tomas Gallardo, one of Trinidad’s heirs before buying the property. During the visit, they were showed them the land’s boundaries. Tomas even helped the Abays build a concrete fence around it.

The Abays openly occupied the property for about 20 years until their possession was disrupted when workers of spouses Jacinto and Chiok Ngo Lim Young (the Youngs), who are claiming ownership over the property, entered it, destroyed the fence, and built their own posts.

The Abays discovered that a title over the property had been issued in the Youngs’ name. This prompted them to file a complaint before the Regional Trial Court (RTC) to cancel the title.

The Gallardos challenged this, arguing that the documents the Abays presented referred to a different lot, Lot No. 6036-B, and not the lot they were occupying, which was Lot No. 7. While both lots were located in the same area, they were separate properties and were not beside each other. The Youngs supported the Gallardos’ position and maintained that they were buyers in good faith.

The RTC ruled in favor of the Abays which ruling was reversed by the Court of Appeals (CA). The CA held that the documents presented by the Abays showed that they purchased Lot No. 6036-B and not Lot No. 7, which they claimed to own and possess.

The SC disagreed and reiterated its pronouncements in previous cases upholding the validity of the sale and allowing the correction of a contract to reflect the parties’ true agreement in instances where the deed of sale failed to accurately describe the land intended by the parties.

The SC stressed that a person buys property based on what they see on the ground, such as its boundaries, landmarks, and improvements, and not by its technical lot number. Ordinary buyers cannot be expected to identify property based only on survey descriptions or legal documents.

Under the 𝘊đ˜Șđ˜·đ˜Ș𝘭 đ˜Šđ˜°đ˜„đ˜Š, a written document may be corrected when, because of a mistake, it does not express the parties’ actual agreement.

The SC explained that a contract may be reformed or corrected if: (1) the parties agreed on the transaction; (2) the written document does not express their true agreement; and (3) the error was caused by a mistake, fraud, accident, or unfair conduct.

In this case, all these requirements were present.

Thus, the Court declared deemed reformed the Deeds of Sale and Extrajudicial Settlement and Sale by changing the designation of the property sold from “Lot No. 6036-B” to “Lot 7” and the Abays as absolute owners of such property.

"Kailangan ba talaga ipa-notaryo?"

May mga simpleng kasunduan na kahit walang stamp ng notaryo ay valid pa rin sa batas. Pero bakit ba kailangan magpa-notaryo?

1. May mga dokumentong "required" talaga: Hindi lahat ng kontrata ay pwedeng basta pirma lang. May mga kasunduan na kapag hindi notaryado, mawawalan ng saysay o hindi tatanggapin ng ibang opisina. Halimbawa nito ay ang mga Deed of Sale ng lupa o mga Special Power of Attorney. Kung hindi ito notaryado, hindi mo maipaparehistro ang titulo o hindi ito kikilalanin ng bangko at gobyerno.

2. May mga dokumentong hindi naman required na ipa-notaryo para maging valid. Usually, ito yung mga pribadong kasunduan, gaya ng Loan or Utang na less than one year lang ang bayaran.

Pero bakit maiigi pa rin ang ipa-notaryo kahit hindi required? Meron kasi tayong tinatawag na "burden of proof." Ibig sabihin, kung magkaroon ng gulo at dinala niyo sa korte, ang taong naghain ng kaso ang may responsibilidad na patunayan na totoo ang dokumento at totoong pinirmahan ito ng kabilang panig.

Meaning, kapag ang dokumento ay hindi notaryado, ikaw ang magpapakahirap magpatunay sa korte na totoo ang pirma ng ka-deal mo.

Pero kapag ang dokumento ay notaryado, nagbabago ang usapan. Ang isang notaryadong dokumento ay itinuturing na "public document." Ibig sabihin, ang batas na mismo ang magpe-presume na tunay ang dokumento at boluntaryong pinirmahan ito. Sa madaling salita, hindi na ikaw ang magpapakahirap—ang kabilang panig ang magpapakahirap patunayan na hindi ito totoo.

Ang bottomline: Ang pagpapa-notaryo ay parang insurance. Habang maayos ang lahat, parang gastos lang siya. Pero sa oras nang hindi pagkakasundo at mauwi sa korte, 'yung notaryadong papel ang magliligtas sa iyo sa haba ng proseso at gastos.

Madalas sa atin, kapag kaibigan o kamag-anak ang ka-deal sa negosyo o pera, nakakahiya magpa-pirma ng kasulatan o kontrata. "Tropa naman" o kaya "Kamag-anak ko naman 'yan, hindi naman ako niyan lolokohin." "Tiwala naman kami."

Pero mas madalas, ang hindi pagiging pormal ng usapan ang sanhi ng pagkakawatak-watak ng magkakaibigan o magkakamag-anak.

Heto ang totoo: Nagbabago ang sitwasyon ng bawat isa sa atin. Ngayon, maaring maayos ang lahat. Pero hindi mo alam ang pwedeng mangyari bukas. Pwedeng magka-emergency, pwedeng magka-problema sa pera, o pwedeng makalimot ang isa. Kapag walang nakasulat, kanya-kanya na ng interpretasyon. Diyan na magsisimula ang "Sabi mo kasi..." at "Hindi ko naman sinabi 'yun..." na nauuwi sa away.

Dahil diyan, huwag nating isipin na ang kontrata ay isang insulto sa pagkakaibigan o pagiging magkamag-anak. Bagkus, ituring natin ang kontrata na parang referee kung may di pagkakaunawaan. Imbes na magduda, silipin na lang ang pinagkasunduan. Kapag may dokumento, hindi na kailangang maging personalan ang usapan. Mas malinaw at kumpleto, mas maganda.

Ang kontrata ay hindi para kwestyunin ang tiwala sa isa't isa. Para 'yan sa proteksyon ng relasyon. Kapag klaro ang usapan simula pa lang, maiiwasan ang samaan ng loob sa huli.

Ang bottomline: Huwag ugaliin ang "bahala na." Kung tunay na nagmamalasakit ang ka-deal na kaibigan o kamag-anak, maiintindihan nito na ang pagiging pormal ay paraan lang para siguraduhing walang masisirang samahan sa bandang huli.
